Do we get a breathing period once ea contract signed

We signed a contract yesterday with an EA for six weeks joint sole agents. Today I have looked at a new build with p/x potential, the builders said it could cause a problem with us having it on with the estate agents.

Does anyone know if there is a breathing space for us to back out of this new contract.

Its not such an issue with the older ea as we are out of contract with them.

    There is no way a part exchange should effect the the sale of the house to them as long as your contract does not say that the EA has "Sole selling rights".

    You are free to sell your house by other menas (your own adverts etc) and not pay your EA commission if you find the buyer as long as the above is true.

    The contract is for 'Joint Sole Agents', we are staying with our current EA and the new one is coming on board.

    Hi,

    Shouldnt be telling you this, but when I was an agent and people decided they no longer wanted to market their property with us, a lot of people rang and said that,, theyd been made "redundant" and were no longer able to move... or " husbands had a back injury and it would be best take the property off the market until its better"... or that theyd simply changed their minds and decided to "stay put".. That way we didnt market their property, as they no longer were in a position to sell
  • Neither of these EA's has found your buyer through their advertising if I understand you correctly. Therefore you do not need to pay them.

    It could be construed that they had found a buyer for you if someone was passing by your house and saw their board, or if someone saw the advert in their window and then approached you privately. However, if you have taken up negotiations with a builder who then offers to take your property in part exchange for a new one, then this is in no way because of anything that the EA has done and they are out of the equation.
