County Court Business/VCS Help!!

Good afternoon all,

I parked in a friends car park to leave my car overnight and received a £60 ticket from Vehicle Control Services. I realise now I may have not taken the best course of action but I ignored all the letters and have now been issued a claim form by the County Court Judgement Centre and if I don't pay I'll get a CCJ.

I've been rather bad anxiety which I take medication for and a few money worries hence my mind set I chose to ignore the letters so I didn't have to think about them which I'm now regretting doing.

They are now requesting £185 payment which I can't afford and I've spent a few days reading the forum but I am at a loss with what to do. Shall I just find the funds and pay or is there anything I can do to fight?

I didn't keep any of the original letters they sent but I'm going to take a look tonight at the signage in the car park.

    What is the Issue Date on your Claim Form?

    I'll assume it came from the County Court Business Centre. ;)

    No-one here will advise you to pay

    If you have used your real name as your forum name then you need to get MSE to change it to something anonymous

    The ppcs monitor this forum and can use posts in your thread against you

    Read up on this now in the newbies FAQ thread near the top of the forum to get an understanding of the game you are now caught up in

    Post #2 in that thread does give comprehensive advice on how to deal with Court claims

    The first job is submit the AOS. All covered in that post

    That will buy you an extra 14 days to respond to the court
  • There are various defences in the NEWBIES which you can adapt to your circumstances.

    Go to Advanced Search using keywords ABUSE OF PROCESS and changing the show results as button from threads to posts.

    Don’t worry about a CCJ this will only happen if you were to lose and ignore the judge’s order for payment.

    Look for Coupon-mad’s post regarding the fake £60 add on.

    You get a CCJ registered against you if you ignore the claim's deadline for a defence or lose in a subsequent court case


    If you subsequently pay it off in full within a month of the date of judgement you can get it removed from the record, otherwise its on your record for 6 years

    Only if they win their case, which, in residential parking claims is not very likely.

    Get a copy of your friend's lease/AST and tell us what it says about parking. Dis you park in a dedicated visitors space, your friend's space or someone else's?

    Read abot primacy of contract, and get your MP on board as nine times out of ten these tickets are scams.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.
