Received a county court claim form. Please help

    There is no cut & dried answer. Gladstones might object to service by email, that's the only issue.

    Personally I would email your entire WS, supplementary WS (you know what I mean from CEC16's thread and the Abuse of Process thread post #14) plus your costs schedule and exhibits and photos, and contents page, to Gladstones (let them stew and sort out the printing rather than you). Just put 'USB video, and printed copy Witness Statement to follow'.

    Then I would post the copied video on a USB stick to them with a printed copy of the WS and contents page and costs schedule only (not any exhibits or colour photos) and state that this bundle follows the email they've already acknowledged on xx.x.2020 which contained the evidence and photos, as they will have seen already.

    As for the court, I would secure the USB stick to the ring of the cheap 'ring binder' file we recommend you send to the court, with the Hearing date, time, claim number and your name on the front, so none of it can be lost or misfiled by the court staff.

    Ah okay makes sense.
    Just to confirm, the costs schedule does not have to be included with the witness statements and evidence. I should just take it into court on the day and show the judge if I win, is that right?

    Your Costs Schedule must be sent to the Court and the Claimant at lease three days before the hearing.

    We are currently suggesting that a Costs Schedule is filed (with the Court) and served (on the Claimant) at the same time as the Witness Statement and evidence.

    It is proof of loss of earnings, e.g. a payslip, that can, and should, be taken on the day.

    No.

    A poster I was lay rep for, would have got hundreds in unreasonable conduct costs, as the Judge was ''this close'' to awarding it but she felt that the costs schedule, emailed 48 hrs in working days before the hearing (in perfectly reasonable time IMHO) was a bit of an ambush.

    So we learnt from that one, and we now say pop it in the court file & to the claimant at WS and evidence stage.
