Hello and thank you in advance,
I have had a good read through everything but cant seem to find a similar story so figured it would be faster to post and get a reply:beer:
Firstly I like to state I have just found this thread and have already appealed unfortunately explaining what I am going to outline below and have pretty much admited it was me because I did not know not to do this, so apoligies for that.
This is what happened. So I parked in a Britannia parking car park last month and upon trying to purchase a ticket it was apparent their card machine was not working, a number of other patrons had the same problem. I tried twice with two different cards and as I dont carry a mobile telephone with me everywhere and I had no change I decided to go to a cash mashine then a shop for some change (on foot) so I could return and pay for a ticket, big mistake, I should have driven as I have now found out there is a grace period of 10 minutes in which to buy a ticket or a fine will be issued automatically which I did not know. All very innocent up to this stage and I clearly tried my best to purchase a ticket.
I have since recieved a postal fine stating I did not display a valid ticket because it was not purchased within the 10 minute slot. Absolute madness. So these !!!!!! now want me to pay a fine despite my best attempts to combat this. The area is very dense and there was no other car parks that I could use due to my van being too tall.
I have recieved a popla code but I no longer have the two failed card reciepts. I asked them to check their PDQ card machine for failed attempts to pay but obvioulsy there was no mention of this in the letter they sent me disregarding my appeal.
Any ideas what I need to do next. I'm fed up to the back teeth of this stuff and I am debating just paying the discounted rate although I do not want these !!!!!! to win.
Any help is greatly appriciated,

you can only win this on a technicality and FRUSTRATION OF CONTRACT due to faulty machines etc
the BPA CoP tells you what the GRACE PERIODS are, in clause #13 , download it and read it, this is what they should follow , but the so called ten minute rule is usually correct, apart from where machines are faulty or vans block the car park etc
read post #3 of the NEWBIES FAQ sticky thread to gain ideas for a POPLA appeal
a complaint to the landowner may also yield results, which I bet you have not done yet, despite it being mentioned in the NEWBIES thread
in future, no blabbing about who was driving0 -
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0
