this is the signage they are using as proof. So do I have any grounds for argument that it doesnt state anywheer that there is a pay and display in operation? The only way I know was revisiting the site for photos I saw the machine tucked at the side but no signs referring to it or its location?

That sign only creates a £100 PCN for permit holders not displaying a permit.
And why would anyone seek out a PDT machine if the signs fail to alert them to that? Even if the Judge thinks the driver was 'at fault', the sign only addresses permit holders, not other members of the public wanting to park, and creates no obligation to pay and display not any contract with non permit holders, at all.PRIVATE 'PCN'? So quick question so.I get this right. I serve the court my witness statement, the supplementary witness statement , my exhibits, costs and wageslip. Then to the claimant is it just the witness statement and exhibits or all the above as court?
Also ive enclosed a video of entry to the car park as a Dvd. Will I need to take.my laptop on the day or play from my phone? Thanks for all the support0 -
A copy of everything you send to the court must be sent to the claimant.
Absolutely everything.
No need to send your wageslip anywhere. Take it with you on the day.
You will need to take something suitable to play the DVD.
It could be alleged that any file on your phone is not the same as the dvd that you have filed and served.0 -
So Ive got a week until my hearing. I intend to get a skeletal argument submitted as advised so it will help me gather my focus on the day. So I read that this.needs submitting in advance is there timescales involved? Do I need to send to claiment also?
Another question, sorry this is the first time Ive ever had a ticket, from the pack they sent me with their WS etc I dont seem to see who the solicitors are that VCS are using, unless Im missing something, or do they represent themselves now?
Thanks in advance, the support so far has really helped otherwise i think I would've just given in.0 -
Will the skellie help the court or the other side? AS one isnt required, why not simply produce one for yourself?
They will send someone on the day, most likely. Just a local hired solicitor.0 -

Hi everyone. so today was the day of my hearing. After a troublesome start, apparrently the claiment hadnt received my statement but more importantly the court hadnt received theirs. I failed at getting the case dismissed on this ground. The court was stepped down for 45 minutes so they could submit and also read my statements.
I mentioned abuse of process but the judge didnt seem to be taking that onboard, although Im not 100% whether that was due to my primary argument that I was under the belief I had permission.
I won my case on the grounds that I went into the box office and spoke with a member of staff for the landowner, whether or not this is the only grounds the judge would have considered I guess I will never know.
Big thanks to everyone on here that gave direct advice or that had the information I needed to compile my defence. The judge commended me on a well put together pack, which without you guys I couldnt have done.
The judge awarded just my loss of earnings as he stated simply loosing a case does not mean the claiment had behaved unreasonably. Either way Im just happy its over with.
On a side note there was an earlier hearing for VCS regarding alleged contraventions at Doncaster Airport. VCS lost that case too.0 -
Well done
Another one bites the dust !!
Another VCS loss , or two !0 -
Yay, glad to hear these two cases were lost. WELL DONE YOU!
ANOTHER VCS ONE BITES THE DUST (ahem, two...)
I also hear that an OPS CCJ was successfully set aside at Brighton Court today, as ParkingMad went to watch - a defendant not previously helped by us or MSE - but they are on board now! All good as this has cost OPS money and they will either have to discontinue or proceed against a person who will be well armed.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
