Fraudulent activity on my account. Can I claim it back?

Hi everyone. I've just been looking over my statements and I've noticed a few regular payments from suspect companies such as "Rate my social" and "MBI pro biller" which have 100% not been made by me. At first I thought maybe I had bought something that was part of these companies but it turns out that's not the case and several others have had the same experience.

These payments were taken on my debit card and have been over the past 4 months. It totals about £350 all in all. Is there any way I can claim this back if it was taken without my permission? I'm assuming not considering how much time has passed.

I realise I'm partly responsibly for this as I've been slack in keeping an eye on my account. I used to be all over it every day but after losing my business/home after going bankrupt I have been living much more simply with a basic bank account and only a couple of payments a month coming out (phone etc). I'm homeless so I don't have any rent/utilities etc to keep an eye on and because of this I didn't feel the need to keep checking every day (and quite frankly I've had enough of dealing with finances for a lifetime). Obviously if someone has been taking money from me on a monthly basis without my permission then I really should have been paying more attention. Also I should add that I've only noticed recently because I've only just managed to set up the banking app (there were complications because of my bankruptcy).

Any advice would be much appreciated. I want to know where I stand really before getting on the phone to the bank.

  • Only the bank can tell you what can and can't be done.

    So suggest you contact them in the first instance

    Your bank will have a process to follow for disputing unauthorised transactions, so read up on their website about what you need to do.

    Also worth checking out the Ts & Cs in case there are any stipulations about the window within which you need to report these.

    You initially say "a few regular payments from suspect companies" but your later reference to money being taken is presumably more accurate?

    If they're regular then it'll obviously be worth ensuring that they're stopped from now as well as sorting out what's gone before, by getting the bank to cancel any Continuous Payment Authorities that may be in place....

    If you truly never authorised these transactions then you should tell your bank. They will likely ask you to sign a declaration confirming non-participation and they can raise Chargebacks for you. Sadly, there are time limits for these Chargebacks and it looks like you may have missed out on some of the oldest ones. Your bank may still have to refund these but be prepared for resistance.

    As Eskbanker says, you also need to get your bank to stop the regular payments. They might say you have to do this, but if you never set up the payments in the first place, that should be their responsibility.

    Don't tell your bank you've been slack in monitoring your account, just tell them you didn't make the transactions.

    Now, I have no idea what these retailers supply, nor whether they trade under different names to what appears on the transactions, nor whether they do have something from you authorising the transactions, and if Chargebacks are done, they may not be contested. However, if they have something from you indicating you did authorise the transactions, they will probably provide this and the transactions will be reinstated.

    The next thing to beware is any contractual obligations that may exist if you did enter any agreements with them. If they are instructed not to put any further charges to your debit card, but the terms of the contracts require you still pay them, they may pursue you for payment by alternate means.
