for a Train parking byelaw PCN, asked the above who they believed was liable seeing PCN said Notice to Owner, but is sent to Keeper. received the below:
Good morning,

"The “owner”, in relation to a vehicle, means the person by whom the vehicle is kept, which in the case of a vehicle registered under the Vehicle Excise and Registration Act 1994 (c. 22) is presumed (unless the contrary is proved) to be the person in whose name the vehicle is registered"

If Toyota finance or Motability are the vehicle owner and you are the keeper, their argument fails at the first hurdle

Same if a hire company owns the hire car and you are hirer, or a leasing company owns it and you are lessee

Just keep playing ping pong until it times out after 6 months

Now ask them which bye-law this comes under, who is required to do the proving, and to whom, and what proof is required.

I "own" my daughter's car, but I have never driven it, and it is not registered in my name.

Nine times out of ten these tickets are scams so complain to your MP.

Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
