Parking fine from ZZPS

I was issued with a parking fine for the 19th May while parking at Luton Station Multistory Car Park. I paid for parking using the app. The company who run (don’t know if they own the car park) are Saba. But the company who I have received the fine are a debt collection company called ZZPS

The issue is when I typed in my reg plate on the app instead of typing SD68 I typed SS68. Simple error as the S and D are so close together.

Anyhow I got the fine on the 5th July. But they state that they sent a previous letter, which I didn’t get. I emailed ZZPS to explain the situation and sent evidence of the payment I made on the app.

They are having none of it. And they stated that I was outside of the 28 days to appeal. Well that would be the case had I got a previous correspondence.

They also stated that I could pay the fine over three months at £60,£60 and £50. But I have replied that I refuse to pay as I have already paid, granted there was a slight error on the input on the app. But I have checked with the DVLA and there isn’t a car registered with the reg plate I put on the app.

What advice would anyone give going forward. I want to fight this but don’t know what my chances are and at what cost in the end. Or should I just pay the fine? Also does anyone know any history of ZZPS and how many cases they have lost in court?
Any advice would be so helpful.

    Zzps won't be taking it to court, but Saba could

    Read all the other Saba train station threads and string it out past the 6 month deadline for bylaws issues

    The advice for you is in all of those other threads, as this is a well known problem, so people won't rehash it for you, all that is needed is some reading in similar threads

    What happened on the day doesn't really matter

    First edit your post to remove details which will allow the PPC to identify you

    The ppcs monitor this forum and can use posts in your thread against you

    No-one here will advise you to pay, and no-one knows how this will pan out

    Get acquainted with the game you are now caught up in by reading up on this in the newbies FAQ thread near the top of the forum

    That explains the various stages this goes through and how to deal with each one

    Debt collectors cannot take you (or anyone) to court. What is the exact wording on the original PCN - oh, you didn't get one! Submit a SAR to ZZPS asking for all the data they hold about you, which should elicit the original PCN. If/when you get it, check if they are pursuing you under bye-laws or breach of contract. Read some other SABA threads and you will see that you just play mail Ping-Pong until it times out after 6 months. In the meantime go to the NEWBIE thread and read post # 1 where you will find an initial appeal template (written in BLUE) send that unaltered. I know it is out of date to appeal but it will look good if/when it comes to small claims court that you tried to resolve it.

    It is not a fine, it is an invoice for the damage they suffered when you mistyped your VRN. Do not pay them a penny unless a judge so orders.

    ZZPS are debt collectors engaged by the PPC managing the car park, they cannot take anyone to court for a parking offence. There are hundreds perhaps thousands of similar cases to yours here.

    Also visit peppipoo, CAG, Legal Beagles, etc, read some of them. Concentrate on POFA and land covered by bye-laws.

    Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Do not contact ZZPS again. They are powerless in this matter. All they can do is write scary letters.

    If you feel you need to do something then write to Saba. This offence times out after 6 months. So you write a series of questions such as "why can't I appeal"? Ask them who is liable the driver or owner. What if your neither?

    Ask these questions slowly, one a month by post. Don't email it's too quick. 3 or 4 questions will see this timed out.

    This is all assuming you've had a PENALTY notice not a PARKING notice. It's amazing how many people confuse the two words.

    The SAR should go to Saba first, to their DPO

    If this was to go to court it should be magistrates court within 6 months under bylaws, which should come from the TOC themselves, not zzps or Saba

    Play ping pong on it until the end of November when it times out

    Nobody here will tell you to pay any money to anyone

    And it's not a fine, nor a parking charge, it's likely to be a penalty notice under bylaws

  • So a quick update.

    Recieved a very blunt reply to an email i sent to ZZPS explaining that i refuse to pay for parking as i had already paid, but due to the error of one letter being wrong.

    And their reply was:

    Good morning

    Once this case is referred to a firm of solicitors, they will be in contact with you.

    Oh so now i wait for the real fun to begin.

    But iam i still wrong to refuse to bow to these people as i have paid for the parking and a slight error and i mean slight error has forced this to be an issue.

    Post 4 of the NEWBIES tells you why it is safe to ignore debt collectors. You should never have emailed them.

    You still haven't edited your post to remove information about who parked, but if you have already told the scammers or their agents then it is a bit late to correct that schoolperson error.

    You are in ignore mode for the next six months, assuming railway byelaws apply to the car park in question.

    After that you tell the scammers to delete your data.

    You should also complain to your M about this unregulated scam.
