Hi All,
I need some help as I have got my first charge notice via post. I was in Waterfield Watford Parking last month with my mother (disabled badge holder) and since she slipped in store, we were delayed to leave the car park.
The official boards (according to Google) state that there is a 2 hour parking permitted, however the photos and the notice state that we had a 3 hours and 4 minute parking at site.
Could someone please help and guide at what templates and what arguments to use for the appeal as I was looking through the newbie threads and there is so many of those and someone in another thread advised to raise a new post to ask here!

There is only one appeal, the one in blue text in post #1
Use it and appeal as keeper on their website, making sure that nobody ticks the Driver options
Do not make any changes, do exactly what I said0 -
At the top of this board is a thread that tells Newbies to read it first. In that thread is a template to use.

Everything you need has already been set out in the stickies, have you read them?
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0 -

Even if neither of the above apply, they should be able to intervene to help in the case of an elderly, disabled customer.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

No new threads are ever needed about Highview. Astonished when I see one, given all you need to do is submit the template from the NEWBIES thread.
They will have cancelled by early next week, as long as the appellant doesn't choose ''I WAS THE DRIVER'' in the stupid Highview Dropdown boxes and doesn't use the awful 'MSE article' template appeal by mistake.

If you mean the initial appeal, it is contained within the NEWBIE thread and you have been pointed to it in posts # 2 & 3 on this thread. It is written in BLUE text to make it stand out. The only way you might not be able to see it is if you are trying to view the forum on a mobile.0

You can add a scan or pic if the BB and state that an occupant of the vehicle was present and here is that proof
No blabbing about who was driving on the day
And be careful when ticking the online boxes, avoiding I was the driver, only appeal as keeper, so do it carefully0 -

Re PCN number:
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:
- If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
- If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.
- in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.
Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.

You can (carefully!) add a little to the template above, 'in order to resolve the dispute I attach copies of...':
- the driver's receipts/bank transactions (or Hospital Appointment/Hotel booking, etc.) that day as 'they' were a genuine customer/patient, etc.
- If an occupant of the car is disabled or elderly/infirm, then the keeper can add that, without implying who was driving. A copy of the Blue Badge (BB) is a good idea to upload/attach, but a person with a long-term debilitating condition (not a broken arm!) can be disabled without a BB, and will be legally entitled to a 'reasonable adjustment'. That can and should include an extension of time, over and above free or paid-for parking time.0 -
I don't know of any other template so yes. Leave out the explanatory notes you've cut and pasted.
If you want to you can attach the BB but to be honest it doesn't make a jot of difference. Provided you send that suitably amended they will cancel.0
