Claim Form CCBC Next Steps Advice

In Aug 2015 I paid for parking in a Premier Park Car Park and then got a letter with a PCN - in fact my wife did... this will end up being significant.

It showed that I had over stayed time paid.

A few key things...

After parking, I put my baby in a buggy and went to pay at the machine. A gentleman was there who only had notes so I gave him my coins, took his note and then tried to pay online. I don’t remember all the detail, but I know it took a long time to either download the app or register my vehicle and card on the phone... I think I actually tried both. Anyway, I paid for 2-3 Hours and - not certain - rushed to return before parking was finished. I then realised baby needed a nappy change - which took place on back car seat and included mess.

This all contributed to me leaving shortly after my paying time.

When I received PCN it clocked my time of entry not when I bought ticket - due to being helpful there was a longer gap than normal - and then leaving time. Again longer due to changing a nappy.

Important info... I appealed and got nowhere - I now see that was not best thing to do - and then have ignored whatever they sent over the last few years, including other PCNs. Also, the car on this occasion is in my wife’s name - many others are not.

Now we have received a Claim Form from CCBC Northampton.

I have read steps and drafted SAR for my wife to send in to Premier Park and will write to solicitors as recommended. I also intend to send in a SAR from myself to cover the fact that i had correspondence with them - hoping this will enable us to see all evidence.

I intend to ask for any photos or CCTV to show me waiting by the machine for what I expect was 10 mins+ trying to sort out parking and also by the car changing a nappy. I asked them to check this in my initial appeal, but got no response - again realise this was pointless.

Is this the best steps to take?
I am hoping my defence could be helped by their CCTV or any still on their ANPR cameras... would they have to let me see that as part of SAR if I give good enough descriptions and time slots?

Is it also helpful getting all data they have anyway so I can start to look at other PCNs that I have ignored too?

    there wont be any CCTV, even if there was it wouldnt identify a person, you have been watching too much NCIS :)

    ANPR cameras take pictures of vehicles, not people, namely the VRM details

    if all the paperwork is in your wifes name, then she is named and only she can get the SAR and defend it, but YOU can help HER to do so if you wish

    its all done in HER name, capiche ?

    the SAR to the DPO at PP will request all docs , pics and data on her and the vehicle, plus any payment paid on the day for said vehicle

    its too late to name the driver , any payment on the day was done in her name , not your name , all this WE and I business muddies the waters. Its not YOUR defence , its HER defence

    YOU havent ignored any pcn,s , SHE has

    I presume this is Premier Park, Exeter ? and not one of a similar name ?


    how many minutes was the alleged OVERSTAY ?

    what is the ISSUE DATE on the top right of the N1 claim form ?

    The reason I am using 'We' is that i had already been in touch and appealed when the PCN first came in - admitting that I was driving and explaining what happened, thinking that they may be reasonable. Clearly, that is not how this works and every bit of correspondence in regards to this claim has been in her name.

    I have drafted the SAR for her to send, so ready to go.

    The date on the claim form is 17 Jul 2019.

    I am not sure of the alleged overstay amount fo time - it was on the initial correspondence 4 years ago, but not sure where that letter is. I assume that will come through with the SAR, but may not be in tim to form the defence.

    To confirm it is Premier Park, Exeter.
