Rebuttals for a LBC are covered in the newbies FAQ thread

    See #2 there

Now that you are at the start of a court claim you should use that post as your Bible

It takes you right through to the hearing with advice on how and when to deal with each stage together with walkthroughs on completion of court forms
  • I'll take another look and review this, thank you.

  • I have composed an email to send to BWL as follows:

    Subject: RE: PCN/Txxxxx

    Dear Sirs

Further your most recent correspondence dated 09/07/2019, and with reference to my recent letter dated 03/07/2019, I wish to inform you that I have now logged a formal complaint to the Information Commissioner's Office in relation to your organisation failing to comply with my correct service address.

As the address update is clearly listed in my letter, it is my opinion that you have chosen to ignore this action in order to send your time critical letter to a different address, in the hope that the timescale you stipulated should lapse before I receive the document, thus giving you an opportunity to file a CCJ against me. I have read many forums with evidence of your organisation carrying out such practices, and I have detailed that, along with my own evidence to the ICO for review.

Furthermore, with reference to your clients evidence, in which your client places reliance upon for pursuing myself, as the registered keeper of the vehicle at the time regarding the above PCN. I have reviewed the pictures included in your correspondence, and I have deduced that there is no proof that my vehicle was not displaying a valid permit to park within Tivoli Court, Portsmouth, nor is there any evidence of my vehicle being parked at Tivoli Court, Portsmouth at all. I also notice that the person whom observed my vehicle did not allow the full 10 minutes grace period as required.

Based on the above findings and information presented, I reject your pursuit for the sum of £160.00 GBP for the above PCN.

    Yours faithfully
    My Name

Does this suffice or should I go into more detail? Looking to send the email ASAP to keep within their timescale printed in the last letter.

you should attach proof of ID as well unless they have approved your email address as being from you, a copy of the V5C or LoC or whatever should suffice, if it has your name and address on it

Ok, good advice thank you. I have long sold the car in question but have retained my private plate which the car at the time was displaying. Could I include a photocopy of my driving licence or would this provide them too much information?

If you no longer have the V5C, you could scan the letter they sent you (albeit to the wrong address) as that should identify you.

As it was to my wrong address that's what I was concerned about but that's fine then, I'll do that. Thank you
