    I did a apply via a phone call and have received the paperwork and it is correct
  • If it does proceed to court then I strongly advise getting legal representation. Does your policy include legal cover? Might be worth asking the insurance company if they will provide legal assistance anyway since you would be looking to recover your costs from them in any case.

    Because this appears to be entirely the fault of the insurance company and you have proof of that you should be able to argue that you reasonably could not have known that your policy was cancelled and took every reasonable step to ensure that you were insured. Furthermore the cancellation was a mistake by the insurance company.

    Any costs you incur, including increased insurance premiums and all court costs, should be recoverable from the insurance company. However, you need to make sure that you make a proper defence if summoned, or they will argue that your poor defence increased the costs.

    Thank you very much for the advice. I have spoken to a solicitor who is also a good friend and he also says I have a strong argument and he is assisting me. Also I did notice on another post someone with a similar problem from the same company???
  • Yeah, it's an issue with a number of insurers. Part of the problem is that the police are a bit over-zealous too and turn what may have been a simple typo somewhere into a massive drama. Clearly it's unreasonable to expect you to check your insurance is valid every single day just in case the insurance company screws up.

    Good news...One Call has phoned me today. They are excepting it was their fault

    and are sending me a letter of indemnity to take to the magistrate. Also, they are refunding all my premiums. Thanks again for all your help.
  • Are they covering your costs too? Like having to take time off and travel to the magistrate court?

    Now they have admitted it you want to be sure to claim for any and all costs.
