    It would obviously aid your case if you still had the letter. I have no idea whether the Claim Company will have kept a copy, you'll have to send them a Subject Access Request (SAR) letter to find out...

    Following all your advice on the forum I made a complaint to Allay claims dated 1st August & sent it recorded delivery.
    Letter below..

    Ref: Invoice Reference number: ................in respect of Santander account number: ....

    Dear Sir/Madame

    I am writing to make a complaint.

    I signed up with your company in February 2016. In October 2016 you wrote to me to inform me that my case. I then received a text from you on 26th October 2016 asking me to complete a satisfaction questionnaire. As far as I understand this is when our business relationship ended.

    On 15th May 2019 I received a letter from you to say ‘we have won’ along with an invoice for £1,250.06. This was in relation to a PPI claim with Santander.

    I will not be paying this invoice for the following reasons;

    1) You closed my case in October 2016, so I no longer have a contract with you. Santander have given me all the information regarding all the correspondence you had with them from February 2016 to October 2016. They have confirmed that they last had any type of correspondence with you in October 2016, which coincides with the time my case was closed. There have not been any further ‘follow ups or chasing up’ from your company since that time.
    2) In the correspondence I received from Santander outlining the details of my complaint they confirm that they received my complaint in June 2011. This is when I originally made the complaint myself. (Please see enclosed letter). It clearly states that they were not able to deal with a certain aspect of my complaint until now.
    3) As this was a redress, under the ‘plevin’ judgement, I do not believe you are entitled to any fee based on my original complaint in 2011.

    I am advising you that if you do not stop harassing me, I will be reporting you to the Ombudsman for breach of ‘General rule 1’.

    Allay have not acknowledge my letter & the harassment has continued. Today I received a text stating...

    Your case with Santander Cards UK Ltd is now being prepared by our Legal Team for COUNTY COURT ACTION. Miss. Palmer your outstanding invoice of £1,250.06 will incur a £50 charge & interest calculated at 8% per annum, charged daily. Please call.
    make immediate payment..


    Please can anyone advise !!!
  • let them go to court and you get register with claim on line a county court on line service where you handle all your claim on line instead of filling forms they will not get intrest they are asking for they have to provide you all the evidence about their claim and move the claim to your local county court it will very expense for them to defend the claim and you can explain every thing to judge if they come to hearing which i am very doubtfull they will come
