Personal injury claim car accident

Hi,

Hoping someone can help clarify a few points for me as I've not had much luck myself.

I'm looking to make a personal injury claim for myself and a passenger in a non fault rear collision. I have not made a claim through my insurer but informed them as not much damage to car and easily can be easily fixed by a friend. However my passenger is suffering with pain and disturbed sleep amongst other things.

I've had bad experience with panel solicitor through my MLP in past. I understand they don't take the 25% due to the MLP.

I contacted a few local firms and all want 25% for something that probably doesn't amount to much.

My question is can I just call the third party insurer and do it through them or will they insist on me using my own MLP. Can I use theirs without them taking the 25%?

My insurer wasn't clear on whether it would impact my policy using my own MLP even though I'm not putting in a claim with them. This is why I'm hesitant to use them.

    25% is the norm if the no win no fee company are successful

    Probably a nwnf company will get you in excess of 25% than you would by DIY ,(unless you know what you are doing of course!

    The passenger needs to make his own claim

    You've been in an accident, so there's a good chance it will impact future premiums even if it wasn't your fault and even if you don't claim from your insurance company.

    If you get a pay out, then that amount as well as the accident will need to be declared for up to the next 5 years depending on insurer

    You can contact the third party insurer directly to see if they will deal with you personally but they may refuse.

    Yes you both can DIY. You just need to tell the third party insurance company you were injured and they will deal with it.

    The difficulty is you will see their Dr and receive their (TPI) offer of settlement.

    How will you know if it's a good offer for what has happened? How will you know what losses you are claiming for are? Do you know how to quantify your losses? Have you kept receipts? Any loss of earnings for either of you? If so, do you know how to calculate it?

    What happens if they don't pay, or make a reasonable offer? Do you know how to pursue a PI claim through the courts and the limitation date to get it started?

    If you are both confident about running your own PI claim go for it.
    Mortgage started 2020, aiming to clear 31/12/2029.

    mmm it does sound complex. Maybe I'll go with the panel solicitors then. When speaking to the local ones, it didn't sound like they would get 25% more than panel solicitors would. At least the MLP will pay that 25%. Only difference I could gauge was that I could probably have better correspondence and updates really.

    Car damage is easy to quantify.
    Personal injury, loss of sleep etc. are hard to quantify so not suitable for DIY. You will probably get a poor offer if you deal DIY with the other insurer.


    I would go with the legal insurance and expect it to be rather slow as clearly their work is pipelined i.e. dealing with other cases at the same time, plus there is always to and fro-ing in the negotiation process to get you the best deal.


    Whilst you deserve to be comensated you probably havent suffered financial due to injuries so just expect it to take a while
    OR
    pay 25% for better quicker service if you like, but seems an unncessary cost just to get better updates and a quicker payout when there is no financial loss (from the injury). Up to you of course.
