Reclaiming benefit you used to have but no longer

Hi

Last year we won an appeal for my son’s PIP and I went about reclaiming the benefits I lost since he lost his DLA. It tool awhile but I did get my Carers Allowance reinstated and backdated but I am still waiting for Tax Credits to sort itself.

My query however is about Income Support. I used to claim IS alongside Carers. Whilst waiting for the tribunal hearing I caved and began claiming ESA from September. My entitlement to IS should go from January last year until September, unless I became no longer eligible (there seems to have been a change in eligibility criteria recently).

How do I reclaim a benefit I should've had but no longer claim or are eligible for but still have a period owed?

I've searched gov.uk sites to no avail.

    If necessary then raise a mandatory reconsideration stating the IS claim entitlement you believe you have. You would supply full details of your Sons PIP issues, including the recent appeal. And all other information required to support payment of IS between January and September last year.

    If you visit the Gov.uk website there is a section on that, how to appeal a benefit decision, which details the mandatory reconsideration process.

    If you phone IS helpline first and have a discussion about what information you need to supply which might assist you in claiming any backdated entitlement, then when you prepare the mandatory reconsideration, it should help you.

    Please be aware that mandatory reconsiderations normally have to be submitted within one month of a benefit decision. However, you can submit them up to 13 months of a decision, provided you ask for the decision to be considered beyond the normal one month and explain the reasons for late submission e.g. Sons PIP appeal affecting your benefit position.

    ** It is not clear from your post, why you think you have entitlement for IS for the period concerned and what decision has been made. But perhaps when you phone IS, you can discuss with them about any missing entitlement and what decision was made to not pay you any amounts.**
