    I'm literally going through exactly the same. However I have photos of the signs of that car park and it does start the contract is with vehicle control services. I can post photos if you need them.

    Have you sent that statement to them? And have they replied?

    Yes we know, but there have been times when it said 'Excel' and the PDT machine tickets come out effectively saying the contract is with Excel.

    The Parking Prankster blogs, and some cases where VCS have fielded duff evidence pics more than once, have shown EXCEL on the signs.

    Yet VCS Witness Statement pretends to rely upon a 2010 contract with Excel, the leaseholder, giving VCS authority, which VCS pretend has lasted the whole time. We know it hasn't and Defendants should seek out and use other photos to prove it said EXCEL and put VCS on the spot.

    Defences about this place can be found by searching the forum for the name Zozulya. JanerRXC I hope you found them in time, and haven't got dragged into defending a claim without having read such cases and the PP blogs first.

    I've been away since late last week and not yet finished the final draft that I will send to VCS.


    I'm not expecting a response from them as I think they're probably more likely to try and 'flex their muscles' - I'll let you know how I get on though.

    I've sent them something similar, with no response. I doubt they will respond. I've sent them numerous emails and they've not replied to any. I have spoken to them on the phone and someone sent my SAR info. I don't know whether to call them again.

    It might be an idea to include a Costs Schedule running to four figures due to their unreasonable behaviour that you will file if a hearing takes place.

    Use those bold words, they are mentioned in the CPRs.

    There is at least one example, possibly more, in post #2 of the NEWBIES thread of a Costs Schedule of several hundred pounds, and I recall one poster achieving costs of £1500 from the Claimant due the the Claimant's unreasonableness.
