I would make absolutely sure who owns this fence by showing the deeds to your solicitor. If this comes down to a legal fight a few pounds now could save thousands later.

because of ill health over the years I have let my back garden overgrow

also have been out of work so unable to pay anyone to do this

I dont think seeking the advice of a solicitor, however well advised and sensible, is going to happen in the forseeable future.

The trouble is, the deeds only show who is responsible for the boundary. It says nothing about who owns the fence. The fence belongs to whoever paid for it to be put up.
    If it sticks, force it.
If it breaks, well it wasn't working right anyway.

So they have removed the fence which you owned. What did they do with it, sell it? Sounds like thief. Cut cut your bushes and other planets - criminal damage.

    I love a boundary argument.

Comes from lack of communication from either side, or bullying, not sure which. But big pull up pants required to tackle this kind of thing.

That was my point! The OP seems to think that the deeds show that he owns the fence, whereas, if he took the deeds to a solicitor, he might find out otherwise.

A solicitor would just ask what we have asked "Who paid for it" and the answer seems to be next doors previous owner.

I would be more concerned about marking the boundary where the original fence was. Make sure any subsequent fences regardless of ownership are in the right place.
