The appeal to the company has been rejected, this is to IAS
I have contacted the landowner, but am yet to receive a response.0 -
Waste of time the IAS won't even read it and send out their one template fits all reply.0

I have read all aboit IAS, but in the newbies thread there is an example of a winning appeal at IAS on the grounds of no keeper liability.
So, given the appeal is already written out and just needs submitting, what have I got to lose?
Worst case I've wasted 5 minutes for the possibility, albeit a small one, that I avoid having to go to court.
So unless anyone can advise of a good reason not to bother, I may as well... or am I missing something?

Hi
I am not ignoring the advice not to bother appealing to IAS and I do value peoples help, but I have seen in the newbie thread that an appeal on the grounds that they cannot invoke keeper liability has worked. So I would like to give it a go on the off chance I can avoid all the letters and possibly court.
So, can someone please give me a little advice.
They make you tick a box to say you'll enter into arbitration with them. I just want to know if their decision is legally binding? If it is I won't bother even trying and will just leave it to a proper court.
Thanks in advance0 -
The IAS offer two separate kinds of appeal. The one is the standard free to motorists who have met the deadline for the first stage of appeal set by the PPC (21 days for IPC operators). Off the top of my head I'm not sure what the deadline is for a hire/lease vehicle.
The result of this level of IAS appeal is binding on the operator (ho ho), but not on the motorist. If the PPC wish to pursue an appeal which has gone their way (85% or so do), it is for them to instigate Debt recovery action and/or issue court proceedings.
The other level of appeal is where (inter alia) the motorist has missed the PPC deadline for initial appeal and can no longer appeal as above.
This costs the motorist £15 and they have to agree to be bound by the findings of the IAS assessor. If this is what is being offered, do the math, as I don't see an any different % win/loss rate than above. Then you've sold your soul to the Devil. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I really don't see the point in engaging in a kangaroo court.0

trying to stand in for CM .......
any appeal to 'skippy' only leads to the appellant feeling at a loss , and any further court cases can be tainted by a failed appeal in the eyes of a less than clued up judge!
CM ... don't know if I did a good job explaining what you normally do so eloquently

The reason I am considering appealing to IAS is because of the section of the newbie thread concerning lease cars I have included below. It would seem that I have a pretty much identical case to this and this appeal was upheld. Surely then it's worth a try, or has something changed more recently?
However, if it's a lease/hire car and a NTK went to the hire firm first, you CAN potentially win at IAS by cribbing from this IAS win wording:

I am willing to bet a whole poond that a judge would throw this out of court. He/she may even award you unreasonable behaviour, (punitive), costs so challenge the scammers to take you to court. You never know how far you can go until you go too far.0

I suppose I just wanted it dealt with as attending court seems like a lot more effort than replying to a couple of replies from the operator on an IAS appeal.
I will however bow to the collective wisdom and await my day in court.
