How to stop a claims company mid claim?

Options
Just found out yesterday that my mother has gone through a claims company to get PPI back from my deceased father's accounts. The one that she has gone through have found that he had PPI with Santander and after a quick check online, I discovered that they take a whopping 36% of any successful claim!

Now, my mother says she has confirmed via text to go ahead with the claim and doesn't want to be awkward and cancel it. Obviously, I want my mum to get everything she's due and not give a chunk of it to a company that have been preying on the elderly. If I put in a direct claim through Santander's website on her behalf, can I bypass the claims company, or has my mum entered into a legally binding contract? We're in Scotland btw and the company is based in Wales, so I don't know if that has a bearing on legal things, Scots Law being different and all.

Any help or advice would be greatly appreciated.

Your mum will, initially, get all the refund back.....followed by a bill from the company.

    Did she sign any paperwork?

Not a fan of claims company but they hardly prey on the elderly.

There is now a cap of 20% (plus VAT) on such fees, so if they attempt to charge more your Mother can complain to the Financial Ombudsman. CMCs are now fully regulated and I expect you haven't researched this fully.

Even if you could do this, the Bank would be legally obliged to inform the Claim Company. But the Bank won't accept two concurrent complaints in any case.

    Yes.

The contract is legally binding wherever you reside in the UK.

Thanks so much, that's really helpful. I'll keep an eye on any bill that comes through and check they're charging the correct amount.
