Hi Everyone
I need some help.
I checked all "NEWBIES thread, it is full of useful information but I could not find anything similar to my case.
Back in March 2018 vehicle was parked on 30min free car park for 23min, my mistake was that registration number was not entered to the machine. The signage on the entrance was quite low and with in the short time during the entrance to the car park only sign "30 mins free" was noticed.
PCN received and there was a lot of letters from the parking company, "debt collectors", and now a letter from BW legal received. I guess next letter will be a Court letter. Have left 8 days to pay 160£ before they take further actions So need some advice urgently.

Also a big mistake was that we responded to the very first letter and provided drivers details.

Parking was 30 mins free, contravention is: Parking Session Expired or Unpaid. (vehicle was parked for 23min)

I am really bad on writing and i could not wright the correct defense myself. As well am extremely busy in my life and can not waste my time on these type of useless battles therefore I am always paying all my parking charges, but made a minor mistake on this one and now being charged ?160 unfairly, I would pay it with no doubt if it would be fair charge for the fair mistake.
Please help.

    The NEWBIES covered your case precisely but you appear not to have followed it.

    You now need to read the guide to court written by bargepole you will find in post 2 of the NEWBIES. This is a step by step guide from LBC to the court date.


    If/when the LOC/MCOL arrives, write to the court and complain about the fake add on £60 charge which is an abuse of process. Don't mention it until you get the claim though as they may reissue it without the fake charge.

    You should also complain to your MP about this unregulated scam, and get photos of the site and signage asap.

    What happened when you complained to the landowner at the time?

    The newbies thread does point out there's no need to be looking for your exact circumstances, though a similar one is actually there!

    You have to accept that despite you being too busy to battle this no-one here is going to do it for you!

    Post #2 in the FAQ does give comprehensive advice on how to deal with Court claims

    But you will have to devote time to this

    So decide how much your time is worth compared with paying it off if a claim does materialize and take it from your decision

    Basically these PCNs are all very similar, exactitude is otiose. Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. .
    You never know how far you can go until you go too far.

    Thanks for quick response.

    All I have done up till now was a total ignorance of all letters related to this case as it was advised on many other forums. I did not write anything to anyone. (only responded to Premier park first letter with driver details)
    I have a photo of the signage.
    So the only way to avoid the court now is to pay 160£ ??? Any other ways to avid court, the biggest problem for me is the time which I do not have at all and the court will take huge amount of time from me the wasted time will cost me more than 160£.

    And it is very hard to get all require information together as I do not understand half of what is written in those threads, What is LOC/MCOL?

    Is it possible to avoid court and reduce the charge?

    Sorry for for not reading threads and asking directly, but I really have not got time.

    Have you had a formal Letter Before Claim? It's sometimes known as a Letter Of Claim.

    You can tell a genuine one as it must give you 30 days to respond and will contain financial information forms. Without those it isn't a formal warning you may be taken to court.

    It mean I have some time before they invite me to court?

    That isn't a genuine Letter Before Claim then. At this stage there is no guarantee of anything. They might take you to court, there again they might not.

    All you can do is wait and see.

    Don't go paying £160 to avoid paying nothing just because you apparently have no time to spend a half day in court locally to kill the scam.

    Takes no longer than a longish medical appointment.
