Help needed. PPI claim with Consumer refund service after bankruptcy

Hi all,

Hope you are all well.

Just need abit of advice please. So long story short. I filed for bankruptcy and at the time I was asked to sign a form that gave the OR permission to check for PPI so I did as they asked. But the form did not ask for any details of companies etc.

Fast forward over 4 year, I get contacted by consumer refund service and they say they will check PPI for free. To be honest I totally forgot I had done a check when filing but let them send me the forms. Turns out I had 4 PPI claims for nearly 17 years ago and not accounts that were included in the bankruptcy. So I let them do there stuff.

Today I got a letter from egg saying that they will pay something back just under £500 but it's going to the OR. I had no idea about this, I really don't care about the money but I am worried about they fees from consumer refund! I have another 3 that may come back, I will not get a penny but may have to pay the fees.

Am very upset as at no point did they ask me if I had ever been declared bankrupt and I think they should have.

Can they still charge the fees to me?

I have worked so hard over the last few years to get back on my feet and this is really worrying me.

Any advice would be amazing.

Thanks Warren

You should definitely have told them that you were a bankrupt, they would then have refused to represent you. The firm will definitely have asked if you were bankrupt or had outstanding unpaid debt.

However, Claims companies are now regulated, so contact the Ombudsman for advice and assistance.

I believe under new regulations, they can't. They certainly would have previously, so you may have got very lucky.

But don't make any more false complaints - you can't get anything back and it will only cause you more stress.
  • Thanks for your replies, I honestly had no idea that it would still be part of the bankruptcy. The form to apply was all done online and I did not see any mention of bankruptcy on it.

As I said the money doesn't matter and I thought that the OR had possibly claimed for what they could and as these were so many years before and not closed accounts that had nothing to do with bankruptcy that it was OK to go ahead.

I will call them and see what they say. Hope fully I won't have to pay fees for something I will never see.
