Im currently claiming the above. I have a daughter that live with me 40% of the time.
Now ex want 50/50. No issues with this. but will this effect the above.
I still would need help to keep roof over our head.

    It will only affect you if you agree with your ex that you are to become the primary carer. If you become the primary carer this could increase your UC depending on your other circumstances.

    Do you currently live alone? Do you get help with rent included and if so do you have any spare bedrooms?

  • Well i have her 4 days a week she has her 3 days.. I assume this make me automatic primary carer at the min.
    I live in rented accomdation.. long story short she use my child as a weapon to get us both out off our home. Got her admitting and saying sorry in text.
    So yes live on my own with my daughter. Now she want 50/50 but she won't make me primary carer.
    At the moment we have a spreedsheet we fill out monthly basis so we know who got her when. I keep all the emails.. I worked out that over last 6 month I had her more than 60/40. She had her 4 days through whole of June.
    We are going down the mediation route. I offered her more days but won't go 50/50.

    I’m confused. You said in your opening post you had her 40% of the time and intend to increase this to 50%. You now say you have her 4 days each week which is 57% of the time.

    Who is getting any benefits (Child Benefit, Child Tax Credit or Child element of UC) for her at the moment?

    If you were the primary carer you would be entitled to the child element of UC (assuming she has not left full time education) and your Local Housing Allowance would be based on two bedrooms rather than one.

    Sorry meant 4 days and 3 days. i thought that was 60/40. My bad.
    I get all the benfits now.. so i assume going 50/50 wont change this. thing is will never be 50/50 she keep palming the child off.
    i just agree to avoid argument and knows she wont have her half the time. I do keep records who she with and when. As i said june she only had her 4 days through the whole month.
    She wont get benfits as she earn too much.

    No problem. It is broadly 60/40 but I think you meant you currently have her 60% of the time and will drop to 50% whereas your opening post says you have her 40% of the time which would increase to 50%.

    Anyway, if you currently get the benefits you can continue as the primary carer and there will be no change to your benefits. It would only become a potential issue if you started having your daughter less than half the time.
