ParkingEYE - got lost. Help needed

Hi,

I got a PCN through the post for overstaying by 1.5 hours in a 3 hour max stay carpark. I got the PCN as the registered keeper, not the driver.

I used the appeal template on this site, citing I was not the driver and was not identifying the driver. PE refused my appeal and gave me a POPLA number. But I don't know what to do next.

I thought I was appealing based on not being the driver but reading the forum, people seem to use all sorts of other reasons (other than not being the driver) at the POPLA stage. Can I not just stick to my guns and say I was not the driver and I'm not saying who the driver was - or do I need another grounds for appealing? Seem some inconsistency from the template to the follow up.... Not sure what I do next and the more threads I read, the more confused I get....

    You say you want to avoid identifying the driver


    You need to urgently edit your post to remove details of who was driving


    The PPCs monitor here and can use posts in your thread against you in Court

    Was this a Golden ticket, as you'll have read about, in the NEWBIES thread post #3?

    If not, then the way to cancel a P/Eye PCN is not by saying you were not the driver, as they usually use a 'POFA compliant' PCN and can hold keepers liable (unless it is a Golden ticket - don't ask, read & look at the link in the NEWBIES thread post #3).

    The easiest way to get a PCN cancelled is to complain to the retail park, and then escalate it to the CEO of the retailers. Most P/Eye PCNs are easy to get cancelled if you make a pain of yourself to the landowner/retailer.

    ALWAYS do that before POPLA, then try again, and again, before POPLA.

    Thanks Coupon Mad. I have read up about "golden tickets" but I can't determine what makes it a golden ticket: is it the date issued not being with 14 days of the incident OR is it "nothing about POFA 2012 on the back". Because my PCN was issued 3 days after the incident but there is nothing about POFA on the back....

    There is a picture of a golden ticket and a full explanation in the NEWBIES.
    Because my PCN was issued 3 days after the incident but there is nothing about POFA on the back...

    !!!!!!, I was looking at the reminder which didnt have POFA. The original PCN does have POFA section at the back. And it was issued 3 days after. So no golden ticket it looks like this time....

    The company in the retail park who I am a valid customer of, have a sign up saying they cant help with parking disputes. I have written to them anyway to see. Not sure they can do much if their contract is with the Retail Park and the PE contract is direct with the Retail park also...

    They are lying, because Parking Eye issue EVERY retailer with a User Manual that gives EVERY retailer the right to cancel any PCNs, with one email.

    Insist that a Manager gets the User Manual out and emails P/Eye. Easy!

    Copy in the retail park owners/agents, who should be pretty easy to Google. I found this which tells you which stores are there but not who runs it, but more Google searching might find that info:

    Why not complain to ALL of the retailers? Halfords & Hobbycraft Head Offices have been pretty good in the past, and all you say is that you & your family were browsing there (no need for a receipt).

    REALLY COMPLAIN. Find the manager who hates P/Eye and will cancel it.
