Court dispute with builder - need expert

Hello, we are currently in a court dispute with a builder over a poor bathroom fit. The bulk of issues are with tiling but there are some other issues with fitting of goods and cosmetically as well. Bulk of issues are tiling though.

We have been told to get a single joint expert to write an expert witness report.

We are trying to find chartered building surveyors which everyone seems to have told us are the right experts BUT every time we speak to one, they don't seem to know the specifics of tiling such as the british standards for tiling etc.

We have been told by court that expert needs to be of calibre of surveyors or architect but if they don't know the tiling standards then how can we use one ?

We are really confused !! Anyone else been in similar situation and been able to find experts ? We have already been told we can't use a local builder.

  • The tricky thing is that the majority of the issues are tiling but there are also some issues with the shower tray for example. The builder has already said he objects to using tile association because they won't cover the other issues BUT ultimately the biggest issue is still tiling!

    So we are stuck with trying to find someone who can cover everything.

    Looked at chartered building surveyors who do reports but none of the seem to truely understand tiling

    Can you not agree that a single expert cannot fairly asses both issues and that therefore you should appoint 2 experts?

    You’d potentially also have to ask the courts permission to appoint 2 rather than 1.

    The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.
  • Thats what i'd really like to do if i;m allowed. OR to tell the court that if the tiling needs ripping out then everything will need ripping out anyway.

    Its small claims so i think if we go to 2 experts being needed then i think the court might bump it up to a bigger court....?

    Should we just attempt to say that if tiling needs ripping out then everything in the bathroom needs re-fitting and it is questionable if anything like the fittings will then be salvageable to use again anyway ?

    We managed to get 3x experts from the tile association so this is the only hurdle we have left. - i.e. to convince the judge it is the right course of action to take.
