  • Hi Coupon mad - I think I found it https://forums.moneysavingexpert.com/discussion/6019089/help-with-defence-please-against-vcs&page=2&highlight=vcs+skeleton

    I will work from this.

I have also had a look at the contract which is between a property management company and VCS. If it is a property management company then this may indicate that the "client" does not own the land.

So I'm going to have a go at a land registry search.

Yep, that's the one I was thinking about. Post #22 of beverlyt's thread shows the skelly I would suggest for a VCS case, plus what exhibits to append as well.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The contract has been signed by SRS as director, but has not been witnessed so breaches the requirements of the Companies Act 2006.
Similarly there is only one signature for the landowner/landowner agent. There should be another company signatory or in the case of a sole trader I believe at least that of a witness.
Have you found out who owns the land yet? If it is not Peter Kenny, then where is the contract authorising him to act for the landowner?

There must either be a contract between the scammers and landowner, or flowing from the landowner to the scammers via an agent.
Both the landowner's name and signature/company signatories must appear somewhere on that contract.
In addition, Kenny's signature looks like it actually begins with a J so I would put the scammers to proof that it was Peter himself who signed it.

I believe the contract does cover the relevant period as I said in a previous post. I do not however believe the contract is valid, and I suggest you put the scammers to proof that it is.

Done a land registry search. The property management company is not the land owner. However the land registry documents appear to indicate there is a 250 year lease from 27 January 2006. Does this complicate things?

05.2006 OMITTED Dock, East AREA 27.01.2006 MS520592 Dock and Central Docks 250 years from 27.01.2006NOTE 1: The lease comprises also other landNOTE 2: See entry in the Charges Register relating to a Deed ofvariation dated 17 December 2015

Edit - I added "omitted" and "area".

Should I order a copy of the "official" documents acceptable in court to show they the property management company is not the land owner?

    Thanks

I'd get a copy of the charges register showing the lease and deed of variation.

OK so I got a copy of the leasehold entry on the land registry and again, the "client" is not the lessee.

I've had a look on gov.uk but I cannot find which service will get me a copy of the charges register. Anybody know how?

Edit - nevermind figured it out. I need to complete a particular application form here:
    https://www.gov.uk/government/publications/official-copies-of-documents-registration-oc2

I understand this will take 7 days to arrive. This will mean if I post tomorrow I will get it back 1 or 2 days before the hearing. Is it too late? It seems too late.

Thanks again for all your help
