Daft question...my mum died recently. Whole estate worth c. £300k and am getting all the paperwork together to apply for probate. A couple of banks have released the funds to me. Will states money to be spilt 50/50 between myself and my children. I have paid for the funeral and wake from my own funds. Can I pay myself back or do I need to wait for Probate to be granted? I have receipts. I am executor and the solicitor is to be the second person on the trust for my children but I am reluctant to use them for simple questions to avoid a large bill.
In addition, there is water leaking in her conservatory which obviously needs fixing. Can I get this done and pay from her money? Or is it technically now my problem?

Make sure that you are keping records sao you can show what you are doing.
RE: conservatory - it sounds as thoguh the hosue currentyl belongs to the estate, so you shoud be able to eitherclaim on the house insurance or get it fixed to prevent further damage, out of the estate. It's not unlike paying to have someone clear / tidy the gerden if you need to do that bfore putting the house on the market.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
Thank you. Records being kept - spreadsheet keeping track of it all. The house is just part of the estate. Need to decide whether to rent or sell it but the estate is split in full between us. Contents are mine but what I’m going to do with an enormous collection of made in China pottery, I don’t know!0
