    And OF COURSE all the added paragraphs need numbers...how do people miss this?

    Having a BB is not a pre-requisite for being disabled, and service providers have a legal duty to make reasonable adjustments to cater for disability. Have you considered a counter-claim for disability discrimination?
    You never know how far you can go until you go too far.

    Interesting, didn't realise this was possible, however I think I'll just focus energy into a tight defence.
  • Hello All

    I've now received my Notice of Allocation and will start compiling evidence and witness statement.

    As mentioned previously, my wife is the defendant, but I've been supporting by writing up the defence etc.

    A couple of queries someone can hopefully help me with:

    1. Can I write to the Court and offer to represent my wife (in person) at Court?
    2. The letter states I must deliver WS, evidence etc. to all parties. Does this has to be done via postal mail or can I e-mail VCS with the docs?

    I've started reading through some of the thread links on the newbies page and will start drafting a WS.

    You can be in court with your wife, she is the defendant and MUST attend, you will be Lay Rep r McKenzie friend (ask Auntie Google for the difference) and can speak on her behalf.


    You deliver the bundle to the court by hand if possible and get a receipt. If you have to post, use first class and obtain a FREE certificate of posting. Deliver to the claimant via the methods allowed. Your claim form will tell you how/where to deliver to the claimant.

    I believe a McKenzie friend can whisper in the defendant's ear, shuffle papers and ensure the correct documents are passed to the defendant at the appropriate time, but may not speak on behalf of the defendant.

    A lay rep can act for the defendant and present the case/answer questions, but the defendant must be present and answer any direct questions when asked by the judge to do so.
    If you intend to do this, you will need to print of a copy of the lay reps right of audience order 1999 and hand it to the judge if required. It can be found here.
