Illegal speed cameras

Here for advice. Just got a speed penalty notice from a dodgy cam van parked in front of a bus stop last week.

I’d post a screenshot of the actual bus stop in which the speed cam van was parked as it’s turning out that the local plod have really fouled up. I’d welcome anyone else’s opinion but I’m now fairly sure most would agree it was illegally parked due to 1. Clearly marked ‘bus stop’ lettering in the lay by, in yellow paint. 2. Clear sectioning if lay bay again in yellow paint. 3. Clear difference between lay-by and ‘bus stop’ lay-by. 4. A sign right next to bus stop (with shelter) that says no parking apart from buses. On top of that I rang a constable last week to complain that traffic was braking dangerously to avoid being caught by cam - because it was actually in a white, completely unmarked van in bus lay-by. Was told that yes it was parked illegally. Got penalty notice today, again rang someone in communications and ‘camera enforcement’ department who says there ‘are spots where they can park legally’ but the woman did not mention designated bus lay-by which was the question I had for her, she will ‘ring me back’ with said locations later but whatever. Lastly, I rang the dept which issued the notice and they just told me to take it to court.

There was also no speed limit signs from short stretch between large four lane roundabout I was exciting, and the van which was parked on a dual carriage way. Could have very easily been ‘40’ due to lack of hazards ie no schools nearby or crossing but turns out it was thirty.

Not happy at all and was wondering what everyone else thought? Yeah speed vans are important so why park them on the cusp of speed limit zones where traffic goes from 50/60 mph to 30? And why not park in the middle of a thirty zone where driving too fast would contribute to an accident?

    Why not ask the Magistrate?

I'm personally of the opinion that you should accept responsibility for your own actions rather than put the blame on someone else. You were speeding, end of story. Take it on the chin and move on with your life.

Camera vans can legally park on yellow lines and in bus stops. Given that your case is therefore hopeless.

Sounds like you're hopelessly clutching at straws. Stick to the speed limit in future.
  • Not sure what you mean as I’ve ‘never clutched at straws’ in my life, thought my point was clear and yes it turned out to be illegally parked :)

The position/parking of the van does not provide you with a defence at all - however angry you feel about it.
  • it turned out to be illegally parked
As in post 5, you need to check the relevant regulations for the restrictions at that location, there will be exemptions which can include speed camera vans.
  • Or go on and try and fight it if you think you have a case....only the other day on the radio some chap did exactly that, cost him £35,000 and he still had to pay the fine.
  • Sanctimony abounds on this thread...some people need to get out more.
