Euro Parking service ticket in a permit zone

Hello,
Really sorry if I am posting about something already discussed - I'm new to the site and have tried to look at the NEWBIE threads but couldn't find anything on my circumstances.
The driver lives on a busy road where there is often no parking. Parking miles away is accepted and walking home, but on this day the driver had heavy shopping, hence the driver was unloading - you can see it on google maps - frensham way harborne.
It could not have been more than 5 minutes. There is a sign maybe a metre down from this on both sides (the blue pole on the left and a white pole on the right), but there are lots of house for sale etc signs up also. The sign was thought to refer to actually inside the close rather than at the opening, and cars are parked here all the time.. So anyway, there has been a fine from euro parking services for £100 or £60 if paid in 14 days. They are a member of the IPA so they can get the keeper's details from the DVLA.

Would you advise to pay the £60 ?. It's just so frustrating because the roads were scoured for 25 minutes for a spot to become available in a one mile radius but there was nothing. Again, sorry to be a pain. Any help would be appreciated.

    Edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people. One has protections in law that the other does not.

    Do this before you do anything else.

    It is not a fine.

    The NEWBIES covers your situation exactly. Send the appeal template in blue text from post 1 of the NEWBIES unaltered from The Keeper.

    Read up on what to do if/when it is rejected.

    This PPC is an IPC members not BPA (or IPA), so there is no viable second appeal stage. You go into ignore mode after your initial appeal unless you get real court papers.
    Loading and unloading is not parking; read the case of Laura Jopson vs Homeguard Services especially paragraphs 19 and 20, plus the IPC CoP concerning grace periods.

    Get your own pictures of the site and signage as well.

    You should also complain to your MP about this unregulated scam.

    The driver had heavy shopping etcetera. ;)

    You need to understand that what happened on the day happened to The Driver. The Keeper was not involved until they got an NTK through the post.

    In the newbies post it says: IPC members are different:

    In the case of CURRENT IPC AOS MEMBERS ONLY, we now advise to WAIT for a Notice to Keeper to arrive and then challenge once online or by email, as the KEEPER, not driver, using the template appeal for IPC members, as shown below.


    Should the PCN be ignored until a NTK arrives in the post and then appeal?
    From what I have gathered, I should then ignore any correspondence short of LBCC?

    It wasn't clear from your posts whether there was a NTD or whether the Keeper received a NTK.
    If there was a PCN left with the driver or on the car by an IPC scammer then the advice in the NEWBIES to wait for an NTK should be followed.

    Hello again, 
    After sending an appeal after the first NTK (which was sent out to me on about day 70 or so as opposed to day 56), I have received several others; I have ignored all of them. I have now received a letter before court action. Having read the newbies thread, I gather this isn't a real LBCC as it is from EPS and they are demanding a payment of £160 - within 14 days. Am I correct to assume my next action should be to complete a subject access request (SAR)??

    That's right - on both counts.

    Whilst it isn't a "proper" LBC, it is likely that you will receive one, so as KeithP advises, submit your SAR now and get ahead of the game - don't forget to attach proof of who you are, scan of the V5C or of the PCN.  PPCs are allowed 30 days to respond to a SAR and we often read about posters who wait until they receive the official Claim Form from Northampton CCBC before submitting a SAR and saying they won't receive it until after the defence deadline.  Info from SAR is more useful at Witness Statement time anyway but you will be well prepared.
