Hi all
I'm dealing with a ticket for a family member who's vehicle received a PCN. They are a BB holder, and the vehicle was parked in a disabled bay.
I'm about ready to just send the one size fits all template, although there is a bit that says you can carefully attach copies of the BB in the hope they'll drop it - my only worry is this may destroy the "don't admit who was driving" argument as the BB holder is the RK.
I still wouldn't admit who was driving because the holder of the BB doesn't have to be driving to utilise it, but it was a windscreen ticket so i'm trying to get this in on day 26 to see if they'll slip up on the NtK part. I just worry if it gets to POPLA stage they may try and correlate the fact that the RK is the BB holder (and also the employee) and assume who the driver was.
Is it worth just doing a standard appeal for now, hoping they slip up on not sending a NtK or attach the BB and see how that goes?

Ask them to cancel as the driver is entitled to a "reasonable adjustment", and get his/her MP on board.
Nine times out of ten these tickets are scams so complain to your MP.
Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0 -
Re. concerns about correlation at the POPLA stage, I think that is very unlikely to happen. Any insured person can drive the car with the Keeper's permission and that's all there is to it.
As mentioned above, you need to edit your post to conceal identity of the driver.0
