Appealing DRP - missed PCN appeal

Please can you give me some advice, we followed the old advice to ignore the PCN and missed the appeal deadline. We are now recieving letters from a firm called Debt Recovery Plus Ltd. I have searched your newbies thread and reaslised we should have appealed the original PCN but I can't in the thread what we should do now we are recieving letters from the debt recovery company. I am worried that if I just ignore it we will get court letters. Any help would be very much appreciated as I just need to know what to do with these letters. thank you so much.

    Too late to appeal now


    See #4 in the FAQ to get advice on ignoring debt collectors


    All you can do now (assuming you have tried to get the landowner/retailer etc to cancel) is wait and see if they take legal action


    They have 6 years to issue court proceedings


    If it comes to that then come back at that time for advice in the FAQ on defending a claim
  • Take the advice in the NEWBIES and ignore debt crawlers.

    They will threaten with scary letters but are powerless.

    They can’t give you a CCJ or come round and take your children !!

    That is highly likely, and apart from paying them in full, including the DCA's unlawful fee there is very little you can do apart from complain to your MP as nine times out of ten these tickets are scams .

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    Whatever happens, DRP cannot issue court proceedings against you.

    Your issue isn't with DRP, it is with the parking company. Which one is it please, then we can advise on potential implications.

  • Thank you all so much for the replies and advice. The parking company who has issued the debt recovery agency is Euro Car parks.
    I will go back to the merchant and try and get them to remove the charge as we were customers of them on the day of the fine and until then i will ignore the letters from DRP.
    I really hope I don't actually get court papers but if I do I will come back and read all the advice on letters before court action.

    Despite them issuing hundreds of thousands of tickets a year, ECP have never taken anyone to court. Are you feeling unlucky?
