    just read on ringo website that they wont get involved if you confirm wrong reg mistakenly. So standard appeal it is. Thank you.
  • Given that parts of the template regarding photos and reason are not applicable, they have been removed. Is the following sufficient or are there other points that can be made for a generic appeal (should i mention that no windscreen pcn was left - it was just a letter in the post):

    'I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement. There will be no admissions as to who was driving and no assumptions can be drawn.

    Since your PCN is a vague template, I require a clear image of the signage.

    Formal note:
    Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service.

    I will not be paying your demand for payment for the following reasons:

    • The charge is disproportionate and not commercially justifiable
    The amount you have charged is not based upon any commercially justifiable loss to your company or the landowner.

    Truly it is fine to send the entire template without alteration. There's no need to mention that it was a postal PCN, not a windscreen ticket.

    There's little evidence that PPCs always read first appeals. Occasionally they succeed but the main purpose of submitting the appeal is to move things forward safely and to receive a POPLA code if and when it is denied.

    How about a landowner complaint? Perhaps tell us more about the circumstances. Landowner complaints are best done in addition to the first appeal but before POPLA.

    Why do you think anyone is going to bother to write a bespoke appeal for you when there is a perfectly adequate appeal already to use?

    What makes you think anyone is going to read your appeal?

    If they do read an appeal, there is just a chance they recognise the MSE forums appeal and put it in the too difficult pile.

    Do what you think best, but do it soon.

    As I asked earlier, when does your opportunity to appeal expire?

  • My friend has submitted their appeal using the template. It did not include anything about ringo getting reg wrong.

    I read a bit of the Schedule 4 as referred to on the newbie thread and it seems to say that private companies can claim money from a keeper if they do not tell who the driver was. If this is the case on what basis can an appeal be successful if a private company has played by the rules, done everything right, included all the things they are supposed to in their NTK, has good signage etc?

    If they have 'done everything right' then you the keeper stands no chance.

    Your job is to show that they have not 'done everything right', starting with their compliance with POFA2012.
  • Well that is what I have been trying to explain on this thread; that I have not identified anything wrong - they comply with the wording / what they are required to state. Timescales all fine. That's why I was trying to discuss whether the keeper should highlight that money was paid but that a digit was wrong on the ringo system. That said, it sounds like that would not have worked either.

    So this seems fruitless, given you state the keeper has no chance if everything has been done by the book and I cannot identify anything done incorrectly. Looks like Keeper will have to pay the charge.
