Lloyds defend ppi claim

Myself and husband have made 5 misold PPI complaints against Lloyds in February of this year. We have had 4 claims upheld. The remaining one relating to a Mortgage we are having problems with. Lloyds rang us on the 11th June asking us for more information. We asked them to put this in a letter format and posted to us, and they advised us that we had to return it by 28th June. We have since contacted them weekly to ask about this letter which they keep saying has been posted by 2nd class and to allow 7 to 10 working days. Today I contacted them again as we have still not received this letter, and was informed that they had defended the claim and another letter had been posted out on 26th June stating this. Has anyone else had any issues like this and what did you do?

What were your reasons for claiming that the mortgage PPI was mis-sold?
Most mortgage PPI complaints fail. It's the good sort of PPI which is still sold today.0 -
The same reason as for the other 4. The Product was surplus to our needs, we had other ways of funding eg full pay if we couldnt work. Just seems strange that the other 4 were upheld, but now its a bigger complaint, post from them doesnt arrive, and we find they have defended our claim.0

A mortgage is (normally) a 25 year commitment. No employer is going to pay full pay for 25 years if you are sick. Besides, your employer can make you redundant, then you have no pay at all.:)
If you believe that "had other ways of funding" why did you buy the PPI and continue making payments? When did you stop making payments?0 -
my main point is, first 4 upheld, 5th one defended, on 26th June, and from 11th June until today all postal correspondence from them hasnt arrived.0

Single premium PPI on a loan (for example) is a different product from monthly premium mortgage PPI.
As a general rule FOS doesn't accept 'we had sick pay' as a valid reason for a mis-sale on mortgage PPI.
(dunstonh might eventually come along and post some links to actual FOS decisions. They know about these sort of things.:) )and from 11th June until today all postal correspondence from them hasnt arrived.
Can't help you with thay.0 -
The remaining one relating to a Mortgage we are having problems with.
Most MPPI complaints fail. So, statistically, that is the expected outcome. It tends not to suffer the technical failings of credit card or loan PPI.. The Product was surplus to our needs, we had other ways of funding eg full pay if we couldnt work.
That does not seem to be realistic. The longest sick pay tends to be 12 months. Whilst 12 months sick pay is a good reason for short term debts, the FOS have been rejecting 12 months sick pay as a reason for MPPI due ot the long term nature and secured debt status of mortgages.Just seems strange that the other 4 were upheld,
Its not strange at all. Your reason is not that strong but can work with short term debts but not so much with long term. That is effectively what has happened here.0 -

How can they come to a decision, when they were asking for additional information, that we didnt send because we never received the letter? They originally told us on the 11th June by phone that the additional information needed to be returned to them by 28th June.0

I rang them several times from the 11th June and was either told to give it more time to receive the letter, or that they would send another letter out.0
