Sending SAR (UKPPO) + claim on hold to BW Legal

    Sorry guys just to make sure I'm on the right tracks here, RK is going to send SAR + claim on hold letters via email.

    Anything else I need to do at this stage for my case?

    Very true, I emailed over both SAR + request to put claim on hold.

    Has anyone found out who runs the retail park yet? Complaints should be flooding in.

    Owned by the Council though? But leased to who?

    From the other posts I found on the forum, someone has said the following
    "From Land Registry records the landowners are Fulton Road Limited or Quintain Limited. Both have same registered address."

    Would you recommend contacting both of these?

    Absolutely, in EVERY retail park case.

    Did you know that in the Beavis case, the majority of retailers asked (especially Matalan) hated ParkingEye and Matalan were well known for cancelling PCNs every day for people.

    Yet it was too late for Barry Beavis by then and when the defence was being drafted for HHJ Moloney stage by his helpers, I was voted down (in the group discussing it) in wanting the retailers' opinions mentioned and the misleading omission of P/Eye not telling shoppers about the 'retailer/customer right to cancellation' that existed but they hid from him completely.

    Hindsight is a wonderful thing and it may not have helped but it was galling in the end to see the Supreme Court swallow 'commercial justification' as an excuse to support the £85 charge, and they were never told that the on site leasehold retailers (whose opinions matter) didn't support it. I really wish they'd known that and been told why Barry overstayed (caused by the stationer shop, not him).

    The facts matter and complaints matter.

    Anyway, YES always complain to the idiots who contract with parking scum.

    Hi guys,

    Received an email response from UKPPO, they sent me pictures of my car/signs/all correspondence.

    All was sent to RK for overstaying by roughly 10 minutes at 1 in the morning - initially the ticket was appealed by the RK stating they regularly visit the retail park and was wrongly charged for reentering the car park outside of the 1 hour period of no return - was sent a reply stating the charge was for overstaying the 90 minute period

    This all happened so long ago I don't even remember making the appeal, any help would be appreciated on movement forward.

    I received no reply from BW Legal

    unless the landowner has been contacted and cancelled, its a case of study everything and await a court claim


    any so called overstay could be covered by the IPC CoP, so download it and read it (the CoP in force at the time)

    I'll be having a look over that now.

    Did I have to fill out any of the BW legal forms? I only sent them an email to request a hold on their claim

    no , definitely not , just assume they are for court cases that do not involve a parking invoice, like tenant disputes or builder disputes etc
