Retention absolutely cannot be withheld without this being explicitly stated within the contract and agreed to by both parties.

Just how many builders or trades will provide formal contracts or ANY of the other legal paperwork already mentioned? as iv said all this protects both party's. I would not allow a single trade to set foot within the gate without providing it. Trust no one and make sure everything is o a professional basis from day one.

In the OPs case, Judging by the post the remedial works should be straight forward and at a relatively small cost, We all know that unfortunately if the builder is paid in full then that will be last time they will answer there phone to the client, If they return do the job as it should be then there will be no issue with payment.

Iv worked around the building trade too long as a fabricator and have PM,d too many jobs to have trust or faith on jobs being completed safely, properly and delivered on budget without when needed ruffling a few feathers.

None of the work carried out in my home had a formal contract. There's not been a problem so far - yes, some snagging was required but work was done and paid for.

I invited another plasterer to have a look and express their professional opinion regarding the work that's been done. They said it was one of the worst cases they have seen and that it would be best to replaster (which in fact would be more complicated than before work started). Funny enough he also said not to pay for it. But I suppose it wasn't legal advice.

My plan is to speak with the builder and come to agreement. I would like to resolve this as quickly as possible as I have no interest in living in a building site for longer than necessary but I will not give up my money (and rights) unless I'm happy with the result.
