    Thankyou, I have thought about that too. The common problem is getting an appointment at the surgery, we can’t get one until the end of the month as it has to be a double appointment and the appointment is late afternoon. I may rearrange for an earlier in the day appointment as I think my Mum is more able and alert then.

  • Does the OP need to get a doctor's opinion, or would a solicitor be able to assess the mother's capacity to execute a LPA? (eg I'm thinking a STEP solicitor).

    Are you sure your mother wasn't also named as an executor in the will ?

    If both sisters were named (as would be very common) they would need to get her to renounce (or reserve her powers) so that they can proceed with a probate application.

    have you explained to your GP that mum needs a mental health assessment for matters related to legal issues ? Sometimes GPs recommend that this is done by psychiatrists particularly if capacity is borderline / variable

    I am pretty sure that my mother wouldn’t have been named as an executor as my Nanna added a Codicil to her Will that my mothers inheritance is to go into trust after my mother was diagnosed with Alzheimer’s.

    Hi I have found out today that you were correct my mother has been named as an executor in her mothers Will. I can’t believe how underhand her sister is being. We have made an appointment to view the Will and we will go from there.
