house next door isnt registered and its affecting my sale

    our solicitor has advised us to tell the auction house as it is a requirement of sale

    THIS will cause you a problem with buyers - at least as much as the state of the property.

    Is the only access to their property across your land? And if so, is their right of way not on your deeds?

    That will cause them a big problem selling if so as the site is landlocked.

    How do you know they don't have any deeds? How long has their property used the access over your property?

    about 40 yearsthey have used the access and the heirs admit they dont have the deeds and the solicitor doesnt either

    we are the only access this place has and they are not on our deeds because they have never registered it .and they are not going to from what we find out now

    Honestly, I think you're coming at it from the wrong angle.

    You need to be offering them access, formalised. This is the only way the place is going to get sold in the near future.
    Being sold is the only way it's going to stop being derelict in the near future.
    Not derelict is the only way it's going to stop blighting your property in the near future.

    There is probably an easement of necessity if that is the only access to the property
