Builder & scaffold

Hi all,

Looking for some advice and general comments here.

What is a 'reasonable time' to allow the builder to remove the scaffolding? We have asked them to remove within 21 days, after that, we will charge them storage fee (at £100 a day) and also the cost of disposal of the scaffold.

The question is whether 21 days is reasonable and whether I am legally permitted to dispose of his scaffold?

    No, you can't dispose of it.


    Who is your contract with? Just the builder? Do you have a written contract at all?


    Builders can not control the scaffolding company.
    Scaffolders are notorious for leaving scaffold up until they need it.

    I have no idea whether you can charge them or remove it but that does not stop you telling them they have 14/21 days whatever.
    If you don't make a fuss they will leave it as long as it suits them.

    We have no contact with the scaffolder, just the builder. The builder doesn’t seem to be in a rush to remove it so just checking what our options are.

    We do have a contract but it doesn’t say anything about the scaffolding.

    You actually have a duty of care over the scaffolding as you are now an "Involuntary Baillee" of it.


    You need to follow the set procedure for items left in your possession, CAB can advise you on how you can eventually dispose of it. This includes being able to charge reasonable storage costs but £100 a day is no where near reasonable.

    The storage fee is more a scare tactic. We are hopefully they will remove it when they see how much it will cost them. I don't even think they will pay up at all.

    As above, the scaffold belongs to the scaffolding company, the builder isn't going to take it away. Not getting it in your contract doesn't help your case, the scaffolders will take it when they're good and ready. You make it sound like they won't have heard this all before. I can guarantee they have and will take it down when they need it.

    I just ring the scaffold firm. There is usually a phone no. on a tag somewhere. Usually down within a week.

    It's a bit a matter of luck. My scaffolding after I had PV panels installed was there quite a time, but they did leave me some scaffold boards to make raised beds. Recently next door had some work done and as I went out the door made a joke about it to the scaffolders. They said it would be gone straight away, and impressively it was, possibly because they had a local maintenance contract and were immediately onto the next property.


    Whilst it's there great for cleaning windows and guttering though!
  • Get in touch with the scaffold company and advise local kids have started climbing it, and you are concerned for their safety as you are not always about to stop them.

    Thanks all. We have asked the builder for the contact details of the scaffolders but haven't heard back yet. I can't find any contact details on the scaffolding boards... will decide what to do next if and when we get the contact details.
