Notice to keeper - NON POFA
Comments

The letter received says NON POFA - MNPR - Manual Number Plate Recognition at the top. Does it say NON POFA because it is outside of the 14 days or can they do it anyway?
Show us your POPLA draft based on non POFA ones and the NEWBIES thread post #3.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Great - you will win. Can you add photos of the lack of clear signs embedded in the document as an illustration for the Assessor? No close-ups.
Remove this - it's pointless. There is no CCTV an POPLA can't access it if there was:Immediately upon noticing the signage once close enough, the driver moved the vehicle from the area and CCTV footage would support this
And beware of saying a 'second visit' as that sort of suggests the appellant was the driver:Again, upon reviewing the signage on a second site visit,PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@Coupon-mad thanks for your feedback, I have updated my draft on here as you suggested. Do I need to add something about the NON POFA title on the parking charge too?
Yes, I have photos too.0 -
Do I need to add something about the NON POFA title on the parking charge too? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

How can you find out when the parking company requested your details from the DVLA? I've seen the SAR request firm but the auto reply says that it can take a month to respond. Is there a quicker way?0
-
They have a month to respond, but in practice it can come within 10 days (notwithstanding it's holiday season). This is the standard template advice I give to people looking to access this data from the DVLA:You should email the DVLA and ask which organisations (when and for what reason) accessed the registered keeper's data from them between a range of dates which includes the date(s) of the parking incident(s). You need to provide the registered keeper's full name and address, the address on the V5C logbook and the Vehicle Registration Mark of the vehicle involved in the parking incident.

This service is free of charge.
Even though you email your request, the DVLA will respond via Royal Mail. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

If they were t o take this to court you might like to consider a counter claim or asking for unreasonable behaviour costs, especially if Elliot v Loake has been referenced. You never know how far you can go until you go too far.0

Forgive my ignorance but if the NTK states NON POFA, and the keeper isn't liable for the parking charge, then what is the need for an initital appeal with the parking company and a later appeal with POPLA0
