Indeed, I cannot answer the question as to what and why the bin lorry did what it did because it drove away and left the other two cars sorting out the mess it had left behind. anyways we will just pay up and be done I think because there are so many pitfalls here, not least being that my mother should have honked the horn first, but she just got out of the way asap!

How 3? The refuse wagon wasn't involved at all, by that logic any car on the road at the time of a 2 vehicle collision is part of that accident?

Evidently it was according to the OP.

Are you absolutely sure about that...? It would be a VERY unusual council who still ran their own household refuse.

I live in the biggest local authority in the UK and they still run their own refuse collection, not very well I'd add.

The OP isn't the underwriter and heard the news 3rd hand.
2 cars in a collision from my seat.

Is that Birmingham? Then I'd agree that they run their own collection service , whilst there have been disruption over time, overall a good service.

Perhaps you'd be so kind as to point to the relevant part of the RTA?

    Which part?
The OP's relative was taking evasive action from their own error eg being too close in the 1st place, the refuse wagons have sensors and cameras on the rear.
Getting up close to a long vehicle how can they see the road ahead to determine when it maybe safe to pass?

Agreed I heard the story 3rd hand, but there were 2 witnesses other than the driver in the car, and also the driver in the car behind who witnessed the whole thing. I guess, yes, technically there were only 2 cars involved in the actual collision, but that collision was wholly caused because of the actions of the lorry. I am still going to drop this and not take it further, but interesting point because although it now seems my mother is to blame for getting out of the way instead of honking her horn and waiting to get hit, all of it was entirely caused by the lorry which (I have just checked) is Council run. If I drove in a dangerous way and drove off and left 2 cars smashed in my wake because of my actions I am sure I would be accountable for something.
