Hi.
The driver has contacted the gym three times now and each time the manager hasn't been in. They suggested to email so they emailed the manager, the customer service team and copied the local MP in.
The manager replied with a "cut and paste" script that again states that the member should appeal and if this fails, appeal to POPLA. They say the gym won't get involved. They incorrectly say premier parking when it is premier park ltd and also say it costs them £20 to get the DVLA details. Isn't it only £2.50? Here is the response below:
"We are not involved in the parking management of this car park, cannot intervene in any parking disputes and do not have access to any information provided to Premier Parking.
If you have received a PCN, you have the right to appeal this through premier parking , this must be done within 30 days of from the date of the letter and must include your membership number in your appeal. Premier Parking will normally reduce a PCN for a member to a £20 admin fee. This fee covers their costs of requesting driver details direct from the DVLA.
In the event you are not satisfied with the outcome of your appeal, you can further appeal this through the Parking on Private Land Appeals on POPLA"
The customer service team happily gave me evidence to prove gym attendance (which I already had). My local MP is yet to respond.
This is so frustrating as they didn't give the landowner details and evidently don't show that they care about their customers.0 -
You can find out who the landowner is.
Try all of the following:
- ask other premises served by the car park who the landowner is / specifically ask gym manager who they are if you haven't done so already.
- do a search of the Land Registry, the information costs £5 I think

So the head office apparently has the landowner details and they haven't got back with them yet. With the PCN 2 week (£60 early payment) invoice ending on Tuesday it seems that an appeal should be put in soon.
Like mentioned in the first post, should anything from the Appeal template be changed and how should the gym attendance evidence be included?
Any advice on the appeal would be appreciated.0 -
Also the gym manager has happily provided proof that the car registration has been entered into the terminal many times before. The image has no personal details apart from the registration, so it doesn't identify the driver. Should this be included with the appeal too?0

Are you able to get a screen shot of the driver's gym attendance record from the gym reception terminal? You can then 'blackout' any identifying details.0

The gym's head office still hasn't got back with the landowner details, which isn't too worrying because the landowner can cancel a PCN at any time.
An appeal to Premier Park was sent using the template and included three lots of evidence of gym attendance with no identification of the driver.
Unsurprisingly, like other posts on here they've asked for the driver details and won't respond to replies until they get them.
It's shocking because the gym tell their members that an appeal with the membership number usually results in a £20 charge which might have begrudgingly been paid for.. But £100 is scandalous.
How should a POPLA appeal be worded? There's a template in the newbies threat but the signage is clear so it might not be won?
Hopefully this can be sorted with the landowner but advice regarding a POPLA appeal would really help, especially on which points to mention.

The signage is ever clear and nor is the keypad inside.
And the motorist is sure they entered the VRN, so it's probably about a typo, not that this is what to concentrate on at POPLA.

As above, signage rarely (never?) cuts the mustard. Take some photos yourself and then evaluate them in the light of the signage section in the Newbies' thread. It's funny how the inadequacies become much more apparent when you analyse the signs and the way they're positioned. If you can, criticise some elements of the signage at the car park, referring to your own photos embedded in the appeal. I reckon it's best to individualise this section in addition to the standard wording.
Have a good look at the keypad again too, is it really user-friendly?
'Landowner Authority' is a perfectly good, ready made section in the Newbies' thread, not usually any need to amend or add to it.
The POFA section is a ready-made too.0
