Starting a new thread as requested by Half_Way
Hi, The keeper of a vehicle received a PCN from Horizon after taking his 81 year old mother with Alzheimer/dementia and limited mobility shopping at Tesco extra, Dunstable, Bedfordshire. He parked up in a disable parking bay stupidly thinking it was like the family parking bays but for elderly people like his mother. Still he looked for signs stating to display blue badges but nothing. The keepr received a PCN The driver went back and what he should of done when he parked up was twist his head right round looked 30 to 40 feet away and 15 feet up and there's the sign saying you must display a blue badge. He did go into Tesco but they say they cant do anything and he must contact Horizon directly. He rang customer services and they say the same thing. Half_way has answered a concern of his thought by contacting Horizon he would be admitting to parking in a disabled bay but he will call them tomorrow.

The blue badge scheme doesn't apply to private land.
The Equality act does , however and this states that reasonable adjustments must be made for those with a 'protected characteristics' ( ie a disability)
not everyone with such a disability may possess a blue badge for various reasons, and they may also require extra time that ANPR cameras will not pick up on.
So by default it could be argued that ANPR cameras and the requirement to display a blue badge infringes on the Equality act, even if you can register in store - that's another step an able bodied person wont have to make, and something that could be seen as having to make a fuss at a customer service point..
So for fireballs case, start a new thread if you havent.
Tell the PPc that an occupant of the vehicle has a protected characteristic if they refuse to cancel and it progresses to POPLA, complain to TESCO.
I would take things further and tell POPLA that an occupant of the vehicle had/has a protected characteristic so the driver needed to use a disabled bay, knowing full well that POPLA do not care about such things as disablity laws/equalities act and will turn down the appeal,
and then on the back of that go guns blazing for TESCO, as they are responsible for the actions of their agents, and they treat their customers who have had parking issues like someone who has walked dog !!!!!! on a new carpet.

disabled bays should have signs next to them with clear instructions on the signs so that a disabled person can read them without leaving the vehicle
clearly their signage was inadequate
the NEWBIES thread near the top of this forum tells you what to do , which also tells you that the ebst way to cancel is a landowner complaint
BUT, I would email Dave Lewis and complain in writing or by email , insisting that he gets the charge cancelled due to the EA2010 , WHICH IS THE OVERRIDING FACTOR HERE
the EA2010 protects disabled and vulnerable people, so as an occupant of this vehicle she was entitled to that protection

Edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people.
Do this before you do anything else.

the DRIVER took their mother blah blah
all the KEEPER has done is received the postal letters etc, since the incident
anything done on the incident date happened to the DRIVER and the passenger (s)0 -
Email the Tesco CEO explaining the circumstances and ask him to cancel.

It's never a good idea to ring a parking company and I would never do that
If there loos were filthy I would complain to Tesco, not phone their contractor cleaner0
