Help what do Driving in Italy, rented car with Sixt Crashed into wall

I filled out a damage form for SIXT about the crash.
I said ''was distracted for a split second that resulted in a turn I could not recover from, and hit the wall''
Sixt are telling me that i cant claim on incurance because i was ''distracted driving'' and are now asking me to pay 9.944,05 EUR for damages.
Is there anything I can do?

What were you doing that distracted you?
I’m guessing you didn’t take out your own insurance?
What can you do? Continue to argue your case but at the same time, start saving.0 -
Isn’t that what insurance is for? Or did you just have 3rd party?0

It's in their interest to deny claims and for amounts like this they probably self insure so every Euro they squeeze out of customers and don't pay themselves is a Euro profit.
perhaps 'Distracted' is a trigger word for an offence in Italy?
I would ask them to provide the section of their insurance terms they are relying on and also make clear that you used the term 'distracted' with the meaning of having your attention focused elsewhere eg on another aspect of driving.
Maybe the road was broken or bumpy , maybe another motorist was driving in a way that required your attention - anything that is a legitimate part of driving0 -
You must have been belting it if a split second distraction has caused you to lose control and hit something.

Surely it shouldn’t matter whether the OP was distracted for a second or fast asleep for an hour. If there was comprehensive insurance he should be covered (subject to any excess). If not, not.0

Insurance doesn't always work like that. Even if you are fully comp phrases like I left the keys in the car and it was stolen or I was on my way back from the pub do not help when making a claim.0

Be careful, "distratto" in Italian is a bit of a false friend: it can mean inattentive in a pejorative way, like our "driving without due care and attention".
I'd find another form of words if you can.0
