Moneyclaim online - No Response - Judgement issued - Options?

Hi,


I had issued a claim online using the MoneyClaim Online service. The claim was not responded so after the mandatory period was over I selected the option to issue a judgement.


The judgement has been issued and it has been 2 months since then - I have had no response to my claim.


Can someone please assist - what are my options?


The only next option it displays is to issue a warrant. This is going to cost me more. Should I issue? What else can I do?


This is against an accountancy firm.

    It is GBP375 including judgement costs.

    As it’s less than £600 unfortunately you don’t have the option to go to the High Court. I would therefore select the warrant option on MCOL.

    They will then issue a County Court warrant and send it to the defendants local County Court for enforcement by a bailiff. The cost of the warrant is added to your judgment amount so although you’ll have to pay in the first instance, it should be recovered.

    Alternatively, if you know they own a property, you could apply for a charging order. However this will mean you’ll only get paid once the property is sold.

    Have you definitely used a physical trading address of the company on the claim? Note that the claim will be invalid and you won't be able to enforce if you used a PO or forwarding address (ie not a physical trading address).

    Are you sure they're still trading and have assets that could be seized?

    If so then apply for a warrant. This extra outlay is added to the claim and you'll get it back provided the bailiffs successfully recover funds or assets..

    Yes, I have used the physical address. I will issue the warrant - I was just checking if that is the best course of action.
