Who’s Fault? Accident at Junction

I was sitting at a junction within a car park waiting to turn left. I was more over to the righthandside due to the tight corner but just over the line if that...a car cleared the corner in front of us and came round to my left. I was still sitting stationary when another car came round the junction to our left and it scraped my rear wheel arch on passing. On stopping the car the driver claimed I was too far over for her to pass. I claimed I was sitting stationery awaiting a gap in the traffic to turn left and that she should have been able to judge how much room she had..she obviously had not been checking her mirrors on passing!
Any opinions appreciated!

If you weren't moving and hadn't been moving for a bit, it's her fault as she wasn't looking.

If she was looking and you'd not left enough space, she should've stopped and glared at you :)

The driver who hit the stationary vehicle is at fault.

Based on your description, she’s at fault for hitting you, a stationary driver (not stationery, unless you’re driving a Staples or WHSmith van :D).

However, I bet you’ll end up arguing over it because she’ll dispute your account and the insurers will probably cave in and go 50:50. Unless you have dash cam footage?
  • No dash cam footage 😣

I suggest notifying your insurers, giving as much detail as you can and making sure the most important factor is stated clearly: that you were stationary and were driven into. Take it from there but have in the back of your mind that she may lie and you’ll share the blame.

Check for CCTV. If there is no evidence then it will probably go 50/50.
  • Applied for cctv! Fingers crossed!
