Can ALL PCN be successfully appealed

Even if I knew that I could very likely get a ticket.

I was visiting a friend and parked in a residential car park without a permit. I knew fully I had no right to park there, but there was nowhere else and there was loads of space available. The impression I'm getting on PCN is that they can all be appealed is this correct?

    Yes they can all be appealed

    Though obviously not all appeals are successful!

    Seems a strange way to try out appealing!

    Firstly, edit your post so as not to identity the driver.

    Secondly, it is possible for a PPC to act fully within the confines of legislation and to successfully win at court. However, they are greedy beggars and in the majority of cases they fail to act "correctly" allowing their claims to be defeated. It is often quoted here that 99% of claims can be defeated.

    why is a permit required? and the requirement to display a permit in a private residential area has no bearing on what any signage says from a private parking company

    Yes of course they can all be appealed! But not all cases can be won. Especially if someone's been a complete idiot.

    We regularly tell posters appealing to the IAS is futile as you invariably lose.

    No, you win some, you lose some, but in residential claims, whether you win or lose at court depends on where you parked, and what the lease/AST of the person whom you visited says.

    Obviously if your parked in a disabled space without showing a BB you are going to struggle. Read this

    and google "primacy of contract". If you feel that you have a case, complain to your MP as nine times out of ten these tickets are scams.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    The subtext would seem to be 'this forum exists to help people avoid responsibility for their actions'. So yeah, troll / disgruntled PPC behind it, I agree.

    But that accusation is readily refuted and I see no harm in doing so, in fact the replies are a credit to this brilliant forum and illustrate its integrity. (I suspect the OP gave up reading them pretty quickly.)

    YEs...you simply name someone else as the driver...usually a made up name at a big random doss-house or overseas.


    Job done...appeal successful...100%.
