hospital pcn appeal help

Hi all

could anyone advise as to my course of action in appealing the following charge?

I was issued with a pcn from Parking Solutions. I parked in a disabled bay but due to being in an extreme rush (medical condition) my badge slipped down from the dash. hence issue of the ticket.
I was going to appeal on the ground of my medical condition and that my badge was placed in the car but wasn’t visible BUT, the parking ticket states that i was parked in a “strictly no parking “ area, which was not the case, instead of the disabled bay.

how do i go about appealing this, as i cant argue my badge fell off the dash due to my haste as i haven’t been penalised for parking in the disabled bay and not displaying my badge?

i did look in the sticky but couldn’t see a reason for appeal in the template given

    OK so get complaining to PALS (Google it) about harassment of a disabled person.

    If the badge wasn’t on display how were they to know the driver is disabled?
  • i’m guessing that if the person who issued the ticket looked inside the car he would have seen the badge, he also. probably saw me “trying” to rush into the hospital as it was issued a few mins after i left the car

    A disabled person parking in a disabled bay is an indicator that an occupant of the car has a disability. A BB is not the only indicator of a disability.
    Only certain people in certain circumstances are allowed to question the use of a blue badge. Unregulated parking scammers and Joe or Josephine public are none of these.

    In any case, the blue badge scheme does not apply on private land so your question is irrelevant. This is explained in the booklet that comes with the BB, is explained on the BB gov.uk website, and explained in the House of Commons library documentation.
    It is an offence to require a disabled person to do something that an able bodied person is not required to do. An able bodied person is not required to display a badge that says they are able bodied. It is unreasonable to ask a disabled person with protected characteristics as defined by the Equality Act to display a badge on private land that they are not required to have.

    My point was towards tho post that suggested claiming harassment of a disabled driver as a course of action.

    If the fact that the driver is disabled isn’t apparent by any means (in this case absence of a BB) then claiming harassment against this characteristic is ludicrous at best.

    I am sure the BB booklet you “quote” also states that a valid BB MUST be displayed clearly at all times

    In this case it wasn’t. If as you say disabled parking spaces/BB aren’t applicable on private land then this whole defence point is invalid anyway

    You can’t have it both ways
