PIP backpay

Hello,

My PIP payments got stopped last November as I didn’t receive the ‘disability and how it affects you’ questionnaire.
I applied for MR and it got declined so as currently still waiting for my tribunal date (website says my centre is very busy at the moment so just have to wait).
If the tribunal overturns the decision, will I get back pay from when the claim restarted in November/December or only from the tribunal date? Or something else?

    If you win the tribunal, payment should be backdated to when payment stopped.

    Just to check, was it a review of the existing claim you had (where they want to reassess you) or was it a renewal claim (where you're coming to the end of your fixed period for PIP payments)?

    Have you made a new PIP claim to bridge the gap?

    If it was just a review, you might be able to persuade a tribunal to make a decision on what rates you should get (still not guaranteed though). Otherwise they'll likely just confirm you either didn't receive the form or not and you'll still have to go through the form filling and assessment anyway which will be a long time to get payments back.

    You might want to make a new claim and if you've then got a new award they'll likely use this to backdate payments sooner as you've already filled out the form and done the medical assessment. Tribunals can take up to 9 months to get a hearing in some areas so if you make a new claim you might get payments earlier whilst waiting for a hearing on the old claim.
