Wrong Registration number please help

I recently appealed to myparkingcharge.co.uk as they want my partner to pay £60 for not paying in their car park. I did give them the drivers name as I believed they would accept that she had made the mistake of entering our other cars registration number. however they have declined the appeal I think this is unfair as she did pay for parking just forgot that her usual car was in the garage. They say we can appeal to the IAS however if we do we forfeit the £60 payment and will have to pay £100 if our appeal fails isn't this harassment? I feel pressured to pay the £60. we did pay for parking and I feel this is really not proportionate. There cameras and machine records would show that I paid for the other reg and that it didn't enter the complex.

They give no option to correspond with themselves any further and I note on the IAS website it says that they only accept legal grounds and not mitigating circumstances. Any advice would be appreciated. Here is some of the correspondence below:-

Having considered the points you have raised and reviewed our records, we are unable to accept your appeal. Our main reason(s) for this decision are as follows:
The signs at the car park make it clear that a valid ticket must be purchased for all vehicles which park/enter the car park, giving clear notice that the land is private property and that a Charge of £100 will be levied if vehicles park outside of the Terms and Conditions displayed; signs also state that when a ticket is purchased, the full and accurate vehicle registration number of the vehicle parked must be entered into the P&D ticket machine. The above detailed vehicle parked without payment of the parking tariff for the vehicle on site and you became liable for the Charge advertised.
In your appeal you have confirmed to us that on the date in question, you were the driver of the vehicle at the time it parked in the car park.
We note your comment that on the date in question you did purchase a ticket, but that you used the registration number CENSORED instead of CENSORED As stated, the Terms and Conditions of parking require that the full and accurate registration number of the vehicle which has been parked on site must be entered; by failing to do that the ticket purchased was invalid and you became liable for the Charge Notice issued.
We have fully reviewed this case and we are satisfied that the Charge Notice was correctly issued. We are unable to accept the mitigating circumstances raised in your representations, your appeal is therefore rejected and the charge will stand; photographic evidence which supports this can be viewed at myparkingcharge

What you should do next - Either:
1. Pay the Charge Notice (CN): In order to settle the Charge, the payment of £60.00 to reach us by 12/07/2019 or £100.00 to reach us by 26/07/2019 must be made. Failure to pay this charge within the stated times, may result in Debt Recovery Action being taken and further costs up to an additional £60 being incurred. Payments can be made online at
myparkingcharge by following the links for "Pay Now", or over the phone by calling 0845 226 9138 by using a valid Credit or Debit Card.
OR:
2. Appeal to the Independent Appeals Services (IAS): If you believe this decision is incorrect, you are entitled to appeal to the IAS. In order to appeal, the IAS will need the following information (which is also contained in the subject header of this correspondence).

Appeals must be submitted to the IAS within 21 days of the date of this correspondence. Please visit .theiasorg for full details on how to submit an appeal online.
It is important you note that if you do make an appeal to the IAS, the reduced charge offered above will no longer apply. You should also be aware that if a payment is made prior to an appeal being made to, or adjudicated by, the IAS AND this is accepted as Full and Final settlement against the CN, the appeal will automatically be dismissed and the matter will be deemed closed. Should you appeal to the IAS and it is unsuccessful, the full amount outstanding (£100) will become payable within 14 days of the date the IAS decision is notified to you. Failure to pay this sum in the 14 day period will result in debt recovery costs of £60.00 being added to the outstanding balance.
It is important we also highlight that no further appeals will be accepted at this office; any such appeal must be made to the IAS.
Please also note that further costs may be incurred should it be necessary for us to subsequently recover any outstanding charge using further debt recovery and/or court action.

    In addition you must realise you are dealing with greedy scammers, of course it's unfair, payment was made, there was no loss, proof will be there that the other VRN was recorded.



    But being reasonable does not make scammers any money and that is their only reason for running their grubby little operation.


    The IAS is not Independent it's there to give an outward image of fairness and credibility, in reality it supports their greedy scam and is another little excuse to pop up the charge to maximum.

    Frustrating situation.

    Most initial appeals fail, that is part of the parking scam. You've already found out that honesty and a sense of injustice alone don't make a blind bit of difference. However by drawing on both those things and using the guidelines and advice here you are very likely to win if this goes to court.

    The offer of a premium rate 0845 number to call has been ILLEGAL since 13 June 2014 - more than five years ago. Regulation 41 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 bans the use of premium rate numbers starting 084, 087 or 09 for contact by customers.

    Complain to the Citizens Advice national Consumer Helpline either on 0345 404 0506 or via the form on the CA website for escalation to Trading Standards.

    The offer of a premium rate 084, 087 or 09 number without stating the call charges immediately alongside is additionally a breach of Ofcom regulations in force since 1 July 2015.

    So what really? All PCNs (including Council) are like that, but private ones are a scam.
    I feel pressured to pay the £60.

    so I would be inclined to let it proceed to court if they are daft enough.

    Nine times out of ten these tickets are scams so complain to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
