Accident possibly not insured

The young driver should simply state she was on a break (even then, only if asked) which is truthful, timings of breaks could be verified if insurers really wanted, - which they wont.
- do not offer additional information if not requested.0 -
Because the insurer will ask, :money:
I've had a few bumps. I have never been asked why I was driving just the details of what happened.
ie "I was driving along and someone else drove into me" I have never been asked why I was driving along in the first place or where I was going.
OP tell your friend to answer the questions asked honestly, she only has to answer the questions she doesn't have to volunteer additional information.0 -
If she is only covered for commuting, and was using her car to travel to other business premises, it's possible she isn't insured. All she can do it put the claim in and see how the insurers react.0

Really? If they ask, which they probably wont, you can legitimately say I was driving to the shops. No fraud. It would be different if you had a sign written car delivering stuff on a daily basis for your work to different locations all the time.
Wonder how many people have a lost it on a bend and wasted their car because they were speeding or driving too fast for the conditions and immediately admitted to the insurers they were breaking the speed limit and then hit a tree because they dont want to commit fraud.0 -
The other car driver is at fault for continuing to drive when not safe to do so.Mortgage free

Depends on the speed of the road I think. 3-5 seconds should be enough time to stop in a 30mph zone, but you will have to be on the ball 100%, not looking at the radio, phone, mirror etc etc. 50mph maybe not.0 -

OP says the other driver was doing 5 mph (ish) and had clearly seen the OP's friend, so no issue regarding speed or ability to stop.0 -

Are you serious? If you are asked a specific question and you knowingly give an answer that you know not to be the truth and you gain a pecuniary advantage from it (payment of a claim is such a thing) then that is the very definition of fraud.

She has spoken to boss who has said she will verify she was in break time and received no reward or payment as she has an unpaid hour lunch break.
I think this has settled her down a bit. The other issue is this woman has got a bit nasty over text demanding the money to repair her car and blaming her entirely for the accident. Ive advised the young girl to go direct to the other womans insurance and claim from them instead of her own insurer as her excess is more then I pay for my yearly insurance and advise the other woman to cease all communication and handle it entirely through her insurance0
